He also <br />stated that the stop sign would go in Friday <br />at tYie intersection of Hoover and West Streets. <br />Councilman Luce Asked for verification by the City Attorney <br />and stated that the City has more liability <br />when we choose to act in a manner that makes <br />common sense but doesn't meet warrants, then <br />we do, certainly by going by the warrants <br />as outlined in the Statutes have more liability. <br />Attorney Rautenstraus stated that he felt the <br />particular case here - the Hoover, West <br />case while it doesn't meet some of the tech- <br />nical warrants; it does from a common sense <br />type standpoint and a pedestrian safety <br />standpoint though it might mean. that a stop <br />sign is appropriate. He didn't see quite <br />as much of a liability problem there, given <br />the .information that x number of children <br />use that, etc. Because you can see a very <br />real specific problem. Therefore, he thought <br />you were better off there than a situation <br />where there is just a general perception <br />that a stop sign should be placed there. <br />It was his feeling that there was even greater <br />potential for liability with stop lights if <br />you don't meet the warrant studies. <br />Councilman Luce requested that the Attorney <br />define for him the difference between, if <br />there is any legally, Statutes between should <br />and shall. The reply was shall is mandatory; <br />should is not quite as mandatory. <br />Mr. Luce concurred with Director Kasch that <br />oversignage should not occur because people <br />either are or sense that people are speeding <br />thru .neighborhoods in view of the liability <br />question. He did not feel that installing <br />stop signs is really a recourse that the City <br />ought to adopt; if this is done haphazardly, <br />and did not favor this as a long term policy. <br />Councilman Cussen <br />Commented that when the Chief of Police works <br />on his budget he ought to have more than one <br />radar unit and there be saturation in cer- <br />tain. areas, especially the area addressed <br />by Councilwoman Johnson to slow down speeders. <br />
