page 13
j Councilman Luce
J1
j' Curt Rautenstraus
i
a
Councilman Luce
Mayor Meier
City Administrator Wurl
~.e%e ~.u~' ~-
c.r~ed d,~ G~c.~e.c~y
~~ / /'
~.
a'
~-
~'
7/3/84
At Saturdays meeting one of the requests I made
was to look into an ordinance that would require
a flow restriction devise, and wonder if they
have any preliminary information to report back
to us on.
I talked about it with Steve Ferris and he stated
that in most of the .construction recently that has
been put in. And he has been checking on that. We
don't require it by Ordinance at the present time.
I think what we would probably do with Councils
permissiony$t the next meeting prepare an ordinance
requiring that. and possibly if we can check with some
other Cities and find some other types of regulations
which go in that same vain.
Requested that the Ordinance be prepared for the next
council meeting.
We'll move on to the next item which is permits
At the Saturday session the Council asked that we
develop an outline of the permits issued for this
year, acid a comparison of the Certificate of
Occupancy been issued. A general status report on
permits, we have enclosed an outline of those in the
information submitted. Along with that Council had
requested an impact analysis be made of the various
funds to determine what impact any sort of action
you might take in relation to permits. We were not
able to develop any of the impact information. We
can certainly address that and come up with that as soon
as possible. We did not have sufficient time to deal
with that aspect. Enclosed i~n~ the information is a
memo from the City Attorney which relates. to the permit
status. We sent along a copy of the update on growth
revenue as budgeted and the amount realized to date
which to some extent will be part of the impact analysis.
We did have that much completed so you would atleast
have that much information. We sent you a memo from
the building department which outline the number of
permits issued to date and another memo which outlines
the number of permits issued, houses under construction
at some stage without Certificates of Occupancy being
issued. We have developed some problems in terms of the
moratorium on buildng permits which deal in part with
individual homeowners who requested a permit and found
themselves in some bind, one of whom spoke at the
meeting on Saturday. The building department prepared
a list of people with like. circumstances or problems.
I believe it was indicated at the meeting that Council
would take thos on a individual basis, consider them,
and address them with whatever was appropriate. I'm
not certain if all of these items submitted are what you
need totally to deal with the problem, but I think that
the City Attorney has a comment that relates to his
memo.
Attorney Rautenstraus I don't have a great dear of comments to make except
to emphasize what we normally do is decisions that
you do make should be based on facts and be reasonable
decisions based on those. facts. If at any time you
feel like you don't have the adequate information or
whatever, you would be in a better situation to make
sure you get that in order to make your decision.
Mayor. Meier There are seven people who have signed up to
speak on this so at this point in time I would like
to ask them to come up and speak to the Council
