She noted that only 13 homes <br />were located on top of the ridge., she asked <br />if that's all that oould be accomodated, <br />would the developer be willing to build <br />only 13 homes. <br />Mr. Ochsner noted that the building only of <br />the 13 would not be economically feasible. <br />If the City Council decided not to accept <br />this proposal the land would simply be sold <br />to someone else,, as the heir were entitled <br />to a profit. Mr. Ochsner noted the Council's <br />concern that the development would go past <br />the ridge. He also stated that the developer <br />would provide a lift station to accomodate <br />the proposed homes. <br />Mr. Farland stated that they are attempting <br />to work with the city in offering fair ex- <br />change. They are giving open space, water, <br />Councilman Cussen moved that the proposal k.~:=; <br />sent to the Planning Commision with stipule;. <br />tion that should this meet their approval, <br />or an amended plan, that no building permit~< <br />be issued on this site, until the Howard <br />Berry Water Treatment Plant is functioning. <br />Seconded by Meier. <br />When are you anticipating this? <br />1986. <br />We would appreciate the opportunity to have <br />the Planning Commission look at this. <br />Steve Yatchak Mr. Ste•e Yatchak, 1091 Azure Way, stated that <br />he had a personal interest in this proposal a:; <br />it was right behind his house. He stated <br />that he had a number of major problems with, <br />this development. He felt that it was in <br />direct conflict with the Louisville Compre° <br />hensive Plan. A second problem stated that. <br />this proposal is outside the Louisville <br />Service Area and that there were significant <br />properties within the Louisville service <br />area that will allow for appropriate develop- <br />ments and growth for Louisville for many <br />years to come. He also noted the problem <br />with the availaba~,'.t~~~tr ted water. He <br />made reference t g d~developers and <br />heirs to estates and felt that council should <br />lead the city to successful growth by <br />intellegent planning. He stated that the <br />development would increase a significant <br />amount of future pressure and desire to <br />extend that road to Baseline Road. He asked <br />sxg~gstax that the plan not be approved. <br />Farland Mr. Farland took exception to Mr. Yatchak's <br />comments relative to greed. Although. it <br />was Mr. Yatchak's personall opinion, Mr. <br />Farland felt that the comment of greea~ <br />developer was out of order. He introduced <br />Mr. John Berman, Attorney for the Teresa <br />Steinbeck. <br />Berman Mr. Berman stated that MrS Steinbeck was one <br />of Boulder County's most generous people. <br />He stated that over 20$ of the monies in the <br />estate are earmarked for charities in this <br />area and in the Denver Metro area. He stated <br />that there is no one in this particular <br />estate that is getting rich. <br />
