Louisville City Council Meeting <br />July 6, 2004 <br />Page 5 of 10 <br /> <br />ORDINANCE NO. 1450, SERIES 2004 - AN ORDINANCE OF THE CITY OF <br />LOUISVILLE ESTABLISHING A TEMPORARY MORATORIUM ON THE <br />PROCESSING OF APPLICATIONS FOR APPROVAL OF REZONINGS, <br />SPECIAL REVIEW USES, AND PCZD GENERAL DEVELOPMENT PLAN <br />AMENDMENTS FOR NEW RESIDENTIAL DEVELOPMENT LOCATED <br />WITHIN THE CITY; CREATING CERTAIN EXEMPTIONS FROM THE <br />MORATORIUM - 2na reading - public hearing 7/6/04 (advertised Daily Camera <br />6/19/04) <br /> <br />Mayor Sisk requested a Staff presentation. <br /> <br />Planning Director Paul Wood explained Ordinance No. 1450, Series 2004, if authorized, <br />would establish a temporary moratorium on the processing of applications for approval of <br />rezonings, special review uses, and PCZD general development plan amendments for <br />new residential development located within the City of Louisville. The ordinance defers <br />determinations on new residential development until such decisions can be directed by <br />the goals and policies of a new citywide Comprehensive Plan, which is anticipated for <br />completion by March 2005. <br /> <br />Based upon that timeframe, the ordinance declares that upon the effective date of the <br />ordinance until March 31, 2005, no application for a rezoning, a special review use, or a <br />Planning Community Zone District (PCZD) general development plan amendment for <br />new residential development or use shall be reviewed, processed, approved, issued, or <br />otherwise acted upon by the City of Louisville. The ordinance further finds that the <br />moratorium should not affect any residential development or use under a Final Planning <br />Unit Development Plan, Special Review Use, or PCZD General Development Plan, <br />which has been finally approved by resolution by City Council and is in conformance <br />with all ordinances, resolutions, rules and regulations of the City. <br /> <br />Mayor Sisk opened the public hearing and asked if anyone in the audience wished to <br />speak for or against Ordinance No. 1450, Series 2004. <br /> <br />David Waldman, 255 Continental View Drive, Louisville, CO, asked if his request to <br />amend the Faber Annexation Agreement would be affected by the ordinance. <br /> <br />City Attorney Sam Light stated Mr. Waldman's request to amend the Faber Annexation <br />Agreement is not affected by the ordinance. <br /> <br />COUNCIL COMMENTS <br /> <br />Council member Keany clarified the moratorium only affects residential rezonings, and <br />special review uses. Commercial and industrial developments are not affected. <br /> <br />Council member Marsella asked if the ordinance automatically expires. City Attorney <br />Light confirmed the ordinance, as written, expires March 5, 2005. <br /> <br /> <br />
