PURCHASE AGREEMENT/DONATION ACCEPTANCE AGREEMENT TERMS <br />The LCC must research and determine that the piece can be acquired under appropriate terms and that enough <br />information is known about the piece to appropriately evaluate its durability and expected maintenance. Specific terms <br />that must be discussed with the donor, artist or seller include: <br />1. Value of the artwork <br />2. Description including title, artist and materials <br />3. Maintenance and conservation plans <br />4. Realistic lifespan of artwork <br />5. Rights to the City for reasonable use of images of the artwork for publicity, educational and promotional <br />purposes <br />6. De -accession plan <br />FUNDING <br />The LCC must determine the cost to purchase the piece and cost of instillation and affirm that appropriate funds are <br />available. They must further determine that funds will be available for the expected ongoing maintenance of the piece. <br />GUIDING PRINCIPLES <br />Looking at the artwork acquisition and instillation as a whole, the LCC must determine that the piece and site selected <br />meets the Guiding Principles for Public Art in Louisville. <br />PUBLIC NOTICE <br />If the Louisville Cultural Council decides to proceed with the proposed Public Art instillation after their initial evaluation, <br />public notice will be made and the public will have an opportunity to comment. <br />A sign will be placed at the proposed installation site for a minimum of 15 days prior to the date of the meeting when the <br />LCC will vote on whether to recommend the piece. Sign should include the following information: <br />1. Description of the artwork <br />2. Proposed Location <br />3. Anticipated lifespan <br />4. Maintenance plans <br />5. Source of artwork (donation/purchase) <br />6. Date, time and location of public meeting <br />7. Contact information for submitting public comment <br />RECOMMENDATION <br />The Louisville Cultural Council will discuss the proposed Public Art instillation at the meeting announced on the public <br />notice. Public will have an opportunity to comment at the meeting comments received in writing will be shared.
