Public Artwork instillations recommended by the LCC will be placed on the City Council Agenda. City Council will vote on <br />whether to accept the LCC's recommendation. <br />Items that have received no valid objection may be placed on the City Council Consent Agenda. Items that have received <br />one or more valid objections must be placed on the regular agenda. A "valid objection" is one demonstrating a reasonable <br />likelihood that the proposed artwork does not satisfy one or more of the Guiding Principles for Public Art. <br />ARTWORK REMOVAL/DE-ACCESSING <br />CITY COUNCIL APPROVAL <br />L <br />From time to time, it may be appropriate for the Louisville Cultural Council to consider de -accessing a piece of Public <br />Artwork, the process of withdrawing an artwork from public exhibition through storage, loan or disposal. Following <br />current Best Practices for Public Art, the LCC may recommend de -accessing a piece that meets one or more of the <br />following criteria: <br />1. Repair of damaged artwork is impractical or the cost is excessive in relation to the cost of the piece. <br />2. Artwork poses a public safety risk. <br />3. The security and condition of the artwork cannot be reasonably guaranteed in the present site. <br />4. Use of the particular public space has changed and re -sitting the artwork would be inappropriate because it <br />would impact the contextual meaning of the piece. <br />5. Artwork is of inferior quality to other works in the collection or is incompatible with the rest of the collection. <br />6. The City wishes to replace the artwork with a work of more significance or appropriateness by the same artist. <br />7. Artwork does not meet the Values or Guiding Principles of the collection. <br />8. Artwork has received documented, unabated adverse reaction from the community over a period of time and <br />modifications of the artwork are not possible. <br />DE -ACCESSION APPROVAL PROCESS <br />1. Evaluation: Louisville Cultural Council will evaluate the piece based on the Removal/De-Accessing criteria. <br />2. Public Notice: Public notice will be made and the public will have an opportunity to provide comment. <br />3. Recommendation: LCC may vote to recommend de -accessioning a piece to City Council. <br />4. City Council Approval: City Council will vote on whether to accept the LCC's recommendation. <br />DE -ACCESSION PROCESS <br />When de -accessing a piece, the artist will first be informed in writing of the decision and will be given right of first refusal <br />to buy back the de -accessioned artwork. Donor will be informed in writing of the intent to de -accession the piece (if <br />applicable). <br />The following means of de -accession will be considered (in order): <br />1. Re -donation, sale or other specific action as agreed upon with the donor or artist at the time of the City's <br />acquisition of the artwork <br />2. Sale of the piece <br />3. Trade for one or more other artworks by the same artist <br />4. Indefinite loan to another government entity <br />5. Destruction of artwork deteriorated or damaged beyond repair at a reasonable cost and deemed to be of no or <br />only a negligible value. <br />9 <br />11.06.17 Draft of Public Art Policy 4 <br />
