The legal descriptions reflected in the property deeds for both 221 and 224 Front <br />Street do not include any portion of a vacated Front Street right-of-way. <br /> <br />3.) An Improvement Location Survey did not reflect the incorporation of any portion of <br />the Front Street right-of-way into the ownership lot record. <br /> <br />4). The Boulder County Assessor's database reflects no record of 224 ½. The legal <br />descriptions for 221 and 224 Front Street do not reference the attachment of vacated <br />right-of-way in the legal descriptions. The City of Louisville Building Division does not <br />have an address file for 224 ½ Front Street. <br /> <br />Wood stated the Planning Commission reviewed this vacation request on July 13, 2004 <br />and forwards a recommendation of disapproval. <br /> <br />Mayor Sisk opened the public hearing and requested an applicant presentation. <br /> <br />Claire Levy, Attorney representing the applicants, distributed copies of the subdivision <br />map. She stated the applicant's family has maintained this property since 1938. She asked <br />Council to legally vacate the right-of-way between 221 Front Street and 224 Front Street <br />based on the history of the City's dealings with this property. She addressed that portion <br />of Front Street and noted it is not a street for vehicular use. She stated there are four <br />proposed points for pedestrian access to the Community Park and contended that all four <br />access points are not necessary. She asked Council to use their discretion to vacate the <br />right-of-way. <br /> <br />PUBLIC COMMENT <br /> <br />Denise Ehrmann, 221 Front Street, Louisville, CO, reviewed the family history of the <br />property and explained four generations have lived on the property. She stated her family <br />has always been an asset to the community by volunteering and that she volunteers every <br />day at Louisville Elementary School. She addressed the petition circulated by citizens, <br />advocating pedestrian connectivity from Front and Main Street, and stated there were <br />misrepresentations made about the property. She asked Council to vacate the property. <br /> <br />Thomas Rafferty, 945 Rex Street, Louisville, CO, stated he lives one block from the <br />subject property, and voiced his hope for a compromise. He explained he helped to <br />circulate the petition requesting pedestrian connectivity from all streets including Front <br />and Main. <br /> <br />Barbara Hesson, 526 LaFarge Avenue, Louisville, CO, stated she also circulated the <br />petition and there were no misrepresentations made about the property. <br /> <br />Laura Nasiatka, 948 Larkspur Lane, Louisville, CO, confirmed that Mrs. Ehrmann <br />volunteers at the Louisville Elementary School and asked Council to consider the least <br />amount of impact to the property owners. <br /> <br />7 <br /> <br /> <br />
