She expressed her desire to meet with the City Staff and <br />further explore the options. <br /> <br />Council member Brown stated his understanding of the applicant's issues and requested <br />Ms. Levy discuss those issues with her clients. <br /> <br />Ms. Levy requested a moment to confer with her clients. <br /> <br />Mayor Sisk granted Ms. Levy's request and asked that the next agenda item, Ordinance <br />No. 1457, Series 2004 be considered. <br /> <br />ORDINANCE NO. 1457, AN ORDINANCE AMENDING CHAPTER 5.08 OF THE <br />LOUISVILLE MUNICIPAL CODE TO ADOPT STANDARDS, PROCEDURES, <br />AND FEES FOR APPLICATIONS FOR LIQUOR TASTINGS AT RETAIL <br />LIQUOR STORES AND LIQUOR-LICENSED DRUGSTORES - 2''a reading - <br />public hearing (advertised Daily Camera 10/9/04) <br /> <br />Mayor Sisk requested a Staff presentation. <br /> <br />Deputy City Clerk Carol Hanson reported the Local Licensing Authority held a work <br />session on August 12 to consider a ordinance in response to House Bill 04-1021, which <br />allows limited liquor tastings at retail liquor stores. Licensees can conduct tastings only <br />if the City first adopts an "opt-in" ordinance, which allows tastings. Tastings then may <br />be conducted in accordance with the state statute and any local restrictions. House Bill <br />04-1021 provides a local government may pass an ordinance allowing tastings to be <br />conducted in retail stores or drugstores with the following limitations: <br /> <br /> · No more than four individual samples of up to one ounce of malt or vinous liquor <br /> (beer or wine) or one-half ounce of spirituous liquor may be provided to <br /> customers. The samples must be free of charge. <br /> <br /> · Tastings are limited to a maximum of 5 hours in one day and hours need not be <br /> consecutive. A local government can provide for a lesser number of hours each <br /> tasting may last. <br /> <br /> · No more than 104 tasting days may occur during any calendar year. A local <br /> government can provide for a lesser number of tastings per year. <br /> <br /> · Tastings may only occur up to four days per week, Monday through Saturday. A <br /> local government can dictate which of the four days tastings can occur. <br /> <br /> · Tastings may not be conducted earlier than 11 a.m. nor later than 7 p.m. <br /> <br /> · Tastings shall only be conducted on licensed premises by a licensee or a licensee's <br /> employee who has completed a server/seller training program. <br /> <br /> <br />
