Louisville City Council Meeting <br />October 19, 2004 <br />Page 9 of 15 <br /> <br />· The licensee can't allow patrons to leave the premises with unconsumed samples. <br /> <br />· The licensee faces the same revocation, suspension and enforcement provisions as <br /> otherwise apply to the license. <br /> <br />The proposed ordinance follows the state limitations and adds the following local <br />stipulations: 1) Licensees must apply for a permit to conduct the tastings. 2) The <br />applicant must provide notice to the Louisville Police Department of the tasting event at <br />least two weeks in advance. 3) The applicant shall provide notice of a cancellation 24 <br />hours in advance. Many surrounding communities have or are in the process of adopting <br />similar ordinances. The Local Licensing Authority recommends Council approval of <br />Ordinance No. 1457, Series 2004. <br /> <br />Mayor Sisk opened the public hearing and asked if anyone in the audience wished to <br />speak for or against Ordinance No. 1457, Series 2004. <br /> <br />PUBLIC COMMENT <br /> <br />Mike Koertje, Liquor Authority Chairperson, stated the Authority has discussed this <br />ordinance, met with local licensees and members of the Louisville Police Department. <br />The licensees believe there are advantages to having this ordinance in place. He noted the <br />City of Broomfield's ordinance served as a model for this ordinance, and the Town of <br />Superior, the Cities of Lafayette, and Boulder have all passed such ordinances. He stated <br />the Local Licensing Authority urges the Council to adopt this ordinance. <br /> <br />Mayor Sisk asked Police Chief Bruce Goodman to comment on the ordinance. Chief <br />Goodman stated the police department has no issues with the ordinance. It follows the <br />provisions of the state statutes. He voiced his support of the additional restrictions at the <br />local level. <br /> <br />Drew Owen, 324 S. McCaslin Blvd, Louisville, CO stated he represents Centennial Wine <br />& Spirits. He voiced his support of the ordinance, and explained in these economic times <br />such incentive could enhance their business. He requested an exception to the two-week <br />notice on the tastings. <br /> <br />coUNcIL COMMENT <br /> <br />Council member Van Pelt asked for the clarification on the two-week notice on a tasting. <br />Mr. Koertje stated through discussions with the police department, it was decided that the <br />police might require two-weeks notice to review the staffing needs for a tasting. <br /> <br />Council member Van Pelt asked if Louisville had any liquor licensed drug stores. She <br />questioned whether that should be a part of the ordinance. There was confirmation that <br />Louisville does not have any liquor licensed drug stores. <br /> <br /> <br />
