Louisville City Council Meeting <br />November 3, 2004 <br />Page 7 of 10 <br /> <br />City Attorney Light clarified Council's three options with respect to Ordinance No. 1453, <br />Series 2004: 1) Approve the ordinance; 2) Disapprove the ordinance and 3) Continue <br />consideration on the ordinance and direct staff to prepare a revised second reading <br />ordinance. <br /> <br />MOTION: Council member Van Pelt moved that Council continue Ordinance No. 1453, <br />Series 2004 to a certain date with direction to staff to prepare a revised second reading <br />ordinance and an easement agreement and related paperwork for consideration at that <br />meeting. Council member Brown seconded the motion. <br /> <br />Council member Van Pelt amended her motion to continue discussion to December 7, <br />2004. Council member Brown accepted the amendment. <br /> <br />VOTE: Roll call vote was taken. The motion passed by a vote of 4-3. Mayor Sisk, <br />Council members Marsella, and Keany voted no. <br /> <br />City Attorney Light explained the motion directed staff to prepare a revised second <br />reading ordinance to approve the proposal. If a vacation is to be approved a vacation <br />ordinance is required, or if an easement agreement is required, approval of the agreement <br />is required. <br /> <br />ORDINANCE NO. 1458, SERIES 2004 - AN EMERGENCY ORDINANCE <br />AMENDING ARTICLE VI, SECTION 1 OF ORDINANCE NO. 554, SERIES 1977, <br />AS AMENDED BY ORDINANCE NO. 994, SERIES 1989, ORDINANCE NO. 1258, <br />SERIES 1997, ORDINANCE NO. 1296, SERIES 1999, ORDINANCE NO. 1378, <br />SERIESE 2002, AND ORDINANCE NO. 1449, SERIES 2004, TO EXTEND TO <br />AND INCLUDING FEBRUARY 10, 2005, THE ELECTRIC AND GASEOUS <br /> FUEL FRANCHISE GRANTED BY THE CITY OF LOUISVILLE, COLORADO <br /> TO PUBLIC SERVICE COMPANY OF COLORADO - 1st and final reading- <br /> public hearing <br /> <br />Mayor Sisk requested a Staff presentation. <br /> <br />Assistant City Manager for Governmental Relations Heather Balser explained Ordinance <br />No. 1458, Series 2004 is an emergency ordinance, which extends the current electric and <br />gas franchise granted by the City of Louisville to Public Service Company of Colorado. <br />The current franchise terminates November 10, 2004 with a proposed extension to and <br />including February 10, 2005, or over a three-month time period. The extension is being <br />requested to allow additional time for consideration of proposed changes to the franchise. <br />The terms, conditions and covenants of the franchise shall remain in full force and effect <br />to February 10, 2005. <br /> <br />The Louisville Home Rule Charter provides an emergency ordinance shall require an <br />affirmative vote of 2/3 of the entire City Council. The facts showing the emergency shall <br />be specifically stated in the ordinance. An emergency ordinance may be introduced and <br /> <br />7 <br /> <br /> <br />
