He felt that an entrance to the <br />park is needed. <br /> <br />Mayor Sisk also voiced his belief the property should be divided 20/20/20. He suggested <br />that there should be some finality in this matter. He supported 20' to the Sawyers, 20' to <br />the Ehrmanns and 20' to the City, without any conditions. <br /> <br />Council member Keany suggested that any future expansion of the residences not exceed <br />the setbacks of the existing lot lines. <br /> <br />Council member Marsella concurred with the comments offered by Council members. <br />She voiced her concern over the vacation of the right-of-way if it will be decided by the <br />Courts. <br /> <br />City Attorney Sam Light explained the Ordinance approves vacating portions of the Front <br />Street right-of-way. The Council's options are as follows: 1) Approve the ordinance as <br />originally written (the entire 60') or 2) Disapprove the current ordinance on second <br />reading. <br /> <br />Council member Keany asked if the ordinance could be modified to provide a 20/20/20 <br />split. <br /> <br />City Attorney Light stated the first version of the ordinance could be modified to approve <br />the eastern and western 20' of the right-of-way and the middle 20' would be subject to a <br />potential claim of abandonment. The agreement calls for quit claim deeds. <br /> <br />PUBLIC COMMENT <br /> <br />Ms. Levy stated her clients would not accept what Council is proposing. <br /> <br />MOTION: Mayor Sisk moved that Council disapprove Ordinance No. 1453, Series <br />2004, seconded by Council member Marsella. Roll call vote was taken. The motion <br />passed by a vote of 5-1. Council member Brown voted no. Council member Clabots was <br />absent. <br /> <br />APPROVAL OF AGREEMENT WITH BOULDER VALLEY SCHOOL <br />DISTRICT FOR MONARCH HIGH SCHOOL TENNIS COURT <br />IMPROVEMENTS <br /> <br />Mayor Sisk recognized Land Management Director Cindy Lair and Project Manager <br />Kathy Kron for their efforts in obtaining a $200,000 grant from the Colorado Lottery <br />funds for the Community Park. <br /> <br />Mayor Sisk requested a Staff presentation. <br /> <br /> <br />
