Louisville Local Licensing Authority <br />Meeting Date: January 27, 2003 <br />Page 4 of 5 <br /> <br />Member Wilson moved to have a Show Cause Hearing for serving an intoxicated <br />person. The Authority went through the numerous reports attached to the <br />incident report and felt there was not probable cause to go forward with a Show <br />Cause Hearing. Chairperson Lipton stated that the establishment should have <br />called the police regarding the disturbance. Attorney Bleau replied that if an <br />offense has taken place in an establishment they have an obligation to contact <br />the police. She continued that the Authority could move forward with a Show <br />Cause Hearing based on this fact; but the suspect was kicked out of the <br />establishment for being argumentative not for displaying disorderly conduct. <br /> <br />The Authority felt writing a warning letter was appropriate. There was no second <br />on the motion to have a Show Cause Hearing. <br /> <br />D. Incident Report - Ruby Tuesdays (11/30/02) <br /> <br />The reports provided to the Authority did not contain enough information to go <br />forward with any type of action. Member Paige stated that it appeared that Ruby <br />Tuesdays did exactly as they should have in this type of situation. Vice <br />Chairperson Koertje felt that it was implied that no alcohol was given to the <br />suspects while at the establishment but it was not stated in any of the reports. <br />Member Wilson mentioned that it was stated in the reports that four written <br />statements were given by employees of Ruby Tuesdays. Those statements <br />were not included in the information given to the Authority. <br /> <br />Member Paige moved to table this item until the Authority meets again in order to <br />obtain additional information needed. Member Wilson seconded. All members <br />were in favor. <br /> <br />E. Incident Report - Henry's (12/07/02) <br /> <br />Vice Chairperson Koertje stated that there was a lack of follow up done on the <br />report but felt a Show Cause Hearing may be in order. The Authority voiced their <br />concern again about the lack of follow up done on the reports. <br /> <br />Vice Chairperson Koertje moved to table this item until the next meeting to obtain <br />more information regarding the incident. Member Paige seconded. All members <br />were in favor. <br /> <br />Chairperson Lipton then made a motion to set up a work session to discuss incident <br />reports received from the police department before the next the Authority meeting. <br />Member Paige seconded the motion.
