City Council <br />Meeting Minutes <br />December 19, 2017 <br />Page 6 of 17 <br />DISTRICTS TO THE OPEN SPACE ZONE DISTRICT — 2nd READING, PUBLIC <br />HEARING (advertised Daily Camera 12/11/17) <br />Attorney Light introduced the ordinance by title. Mayor Muckle opened the public <br />heanng. <br />Planner Ritchie noted all public notice requirements have been met. She stated Section <br />15-3 (b) of the Louisville Charter requires an open space zone district into which shall <br />be placed all land which is located wholly within the City and which has been <br />designated as open space In 2011, the City approved an ordinance establishing the <br />Open Space Zone District, and rezoned Davidson Mesa, Hillside, and Damyanovich <br />Open Space properties with the intent to continue to rezone properties <br />She reviewed the properties under consideration for rezoning including the Aquarius <br />property. The criteria to be considered for open space are <br />1 The land to be rezoned was zoned in error and as presently zoned is inconsistent <br />with the policies and goals of the city's comprehensive plan <br />2. The area for which rezoning is requested has changed or is changing to such a <br />degree that it is in the public interest to encourage a redevelopment of the area. <br />3. The proposed rezoning is necessary to provide land for a community -related use <br />which was not anticipated at the time of the adoption of the city's comprehensive plan, <br />and such rezoning will be consistent with the policies and goals of the comprehensive <br />plan. <br />4. The rezoning would only permit development which, if evaluated as a proposed <br />annexation under the annexation standards and procedures codified in Title 16, would <br />qualify for annexation <br />One or more of the criteria must be met to approve a rezoning. Staff finds the properties <br />meets critena #1, #3 and #4 are not applicable but criteria #2 is met. <br />Staff recommends approval of the ordinance. <br />Councilmember Maloney asked why the Lake Park Property is not included this <br />evening. Open Space Manager Brignull stated this has to do with the management of <br />the property, it is designated as open space but maintained like a park so staff is <br />continuing a discussion on this before moving forward. Walnut Park also should be <br />included in that discussion. <br />Mayor Muckle asked about the other properties Brignull stated staff hopes to get the <br />rest of the properties completed in 2018. <br />Councilmember Stolzmann stated she finds the criteria have been met for zoning. She <br />added she would like the Admore Open Space included for future consideration. <br />Brignull stated staff is looking at Admore and other jointly owned properties as a phase <br />2. Councilmember Stolzmann suggested those be noted on the map <br />
