INTERGOVERNMENTAL AGREEMENT <br /> U.S. 36 Corridor <br /> This Intergovernmental Agreement by, between and among the the Regional <br /> Transportation District (RTD),and the Cities of Boulder, Broomfield, Louisville, and <br /> Westminster, the Town of Superior and the Counties of Boulder and Jefferson, all home rule <br /> cities, bodies politic and corporate or political subdivisions, municipal corporations or special <br /> districts of the State of Colorado (the signatory cities, towns and counties are herein after <br /> referred to collectively as the "Local Governments," and all signatories are herein-after <br /> referred to as the "Parties") is made to be effective on the day of <br /> 1996. <br /> WITNESSETH: <br /> WHEREAS, §29-20-101, et seq., C.R.S., as amended, enables the Local <br /> Governments and RTD to enter into intergovernmental agreements to plan for and regulate <br /> transportation corridors and associated land uses, in order to minimize the negative impacts on <br /> the surrounding areas and protect the environment, and specifically authorizes the Local <br /> Governments to cooperate and contract with each other for the purpose of planning and <br /> regulating the development of transportation facilities and land; and <br /> WHEREAS, the U.S. 36 corridor from I-25 to the Foothills Parkway is a significant <br /> transportation link between the Local Governments and the rest of the Denver metropolitan <br /> area and is significantly compromised as a transportation artery due to rush hour congestion, <br /> requiring concerted action of the Parties to mitigate such congestion at its origins and on the <br /> existing roadway; and <br /> WHEREAS, there are significant transit options and open space areas along the U.S. <br /> 36 corridor which are in urgent need of protection; and <br /> WHEREAS, in order to ensure that the unique and individual character of the Local <br /> Governments are preserved, the Parties believe that a plan which recognizes the annexed areas <br /> and development planned and approved by and open space planned and required by each <br /> community along the U.S. 36 corridor, may be in the best interests of all of the Parties; and <br /> WHEREAS, the RTD has specific responsibilities for planning, funding and <br /> implementing transportation improvements for the U.S. 36 corridor; and <br /> WHEREAS, the Parties desire to enter into this Intergovernmental Agreement in order <br /> to provide a vehicle to study the U.S. 36 corridor; and <br /> WHEREAS, the functions described in this Agreement are lawfully authorized to each <br /> of the Parties which perform such functions hereunder, as provided in article 20 of title 29; <br /> 1 <br />
