Draft 12/04/08 <br />ORDINANCE NO. <br />SERIES 2008 <br />AN ORDINANCE ENACTING A NEW CHAPTER 8.64 OF THE LOUISVILLE <br />MUNICIPAL CODE CONCERNING RESH)ENTIAL TRASH AND SINGLE STREAM <br />RECYCLING COLLECTION SERVICES AND IMPOSING FEES FOR SUCH <br />SERVICES <br />WHEREAS, pursuant to Section 30-15-401, C.R.S., the City is authorized to provide <br />residential trash services for the collection and transportation of ashes, trash, rubbish, garbage, or <br />any other discarded materials and to impose fees for such services except that the City may not <br />compel industrial or commercial establishments or multifamily residences of eight or more units to <br />use or pay fees for City-provided trash services; and <br />WHEREAS, City Council finds that providing residential trash services is in the public <br />interest for a number of reasons, including without limitation, the overall costs of trash services may <br />be reduced, wear and tear on streets caused by a multiplicity of trash trucks may be reduced, and the <br />quality of life of City residents and public safety are benefited by not having multiple trash haulers <br />operating within the City; and <br />WHEREAS, the City has complied with the statutory requirements to provide residential <br />trash services and to impose fees for such services; and <br />WHEREAS, in recognition of the desires of the community, as evidenced by the 2008 <br />citizen survey, the City Council is committed to a City trash and recycling services program, and the <br />City Council finds that implementing a residential single-stream recycling program in conjunction <br />with the City's collection of trash may increase the recycling of household goods; and <br />WHEREAS, the City Council intends that the City's trash and recycling services program <br />be self-supporting and finds that it is necessary to impose fees for such services; and <br />WHEREAS, the City Council finds that in order to ensure sanitary practices in the <br />collection of trash and recyclables that the City's billing, payment and enforcement practices for <br />such service be the same as those for the City's water services; and <br />WHEREAS, the City Council desires to enact a new Chapter 8.64 of the Louisville <br />Municipal Code concerning residential trash and recycling services within the City and imposing <br />fees for such services; and <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE <br />CITY OF LOUISVILLE, COLORADO: <br />Section 1. Title 8 of the Louisville Municipal Code is hereby amended by the <br />addition of a new Chapter 8.64 to read as follows: <br />13 <br />
