COUNCIL COMMUNICATION <br />TO: MAYOR AND CITY COUNCIL <br />FROM: MALCOLM FLEMING, CITY MANAGER <br />DATE: DECEMBER 9, 2008 <br />SUBJECT: REFUSE AND SINGLE STREAM RECYCLABLES COLLECTION PROGRAM <br />ORIGINATING DEPARTMENT: PUBLIC WORKS DEPARTMENT <br />SUMMARY: <br />As the City moves forward to implement a refuse and single stream recycling collection <br />program it will be necessary to adopt an enabling ordinance. The attached ordinance has been <br />prepared by City Attorney and City staff to implement such a program. The ordinance provides <br />guidance and regulations on waste collection and provides for fees to be established by a <br />separate resolution. Staff is presenting the ordinance to City Council at the work session for <br />review and discussion. One of the more controversial issues of a refuse and recyclables <br />collection program is including collection fees in a customer's utility bill. The current draft <br />ordinance provides for discontinuing water service if the utility bill is not paid in full. This <br />arrangement is typical of communities implementing refuse and recyclables collection <br />programs. However, this is a measure of last recourse and other arrangements would be used <br />prior to discontinuing utility service. <br />Attached is a working copy (80% complete) of a contract that would implement arrangements <br />with the selected hauler. Also attached is a copy of the agreement between Lafayette and <br />Boulder County regarding acceptance and fees for recyclables brought to the recycling facility. <br />Louisville and Boulder County will need to execute a similar document. These three documents <br />are the primary documents that will need to be adopted or approved in order to implement a <br />refuse and recyclables collection program. <br />FISCAL IMPACT: <br />Staff anticipates that the expenses of this activity will be offset by user fees and revenues from <br />recyclable materials <br />RECOMMENDATION: <br />Discussion <br />ATTACHMENT(S): <br />1.
