Draft 12/04/08 <br />Sec. 8.64.030. Recycling -handling and collection requirements. <br />A. All recycling materials shall be drained of liquid before being <br />deposited for collection. <br />B. Single-stream recycling containers for those persons subject to the <br />city's single-stream recycling services shall be provided by the city or its <br />contractor as described in section 8.64.060. Such containers shall be used only <br />for the collection of materials deemed as recyclable through asingle-stream <br />recycling system by the city's designated recycling facility. <br />C. No person shall place, leave, deposit or dispose of any recycling <br />materials on any street, alley, or other public place, or on any private properly, <br />unless the recycling materials are wholly contained within a single-stream <br />recycling container. Any accumulation of recycling materials in violation of this <br />chapter is declared to be a nuisance and is prohibited. <br />D. Recycling containers shall be kept off the street, curb, sidewalk <br />and all other public ways, except on the scheduled day of collection, and then <br />only for a maximum of twelve (12) hours before and twelve (12) hours after the <br />scheduled time of collection. <br />Sec. 8.64.040. Trash and recycling materials responsibility. <br />A. Trash and recycling materials shall be gathered, deposited, <br />disposed of, and placed in the manner provided for in this chapter by the owner, <br />tenant, or occupant of the property, or the agent or contractor of any of the <br />foregoing, and each of the foregoing persons may be held jointly and severally <br />liable for any violation of this chapter. <br />B. It shall be unlawful for any person to set out or allow to be set out, <br />deposited, or stored for collection any trash or recycling materials other than that <br />which has accumulated from the regular residential use of the premises upon <br />which such trash or recycling materials are set out, deposited, or stored for <br />collection. <br />Sec. 8.64.050. City residential trash collection services. <br />A. The city, its contractors, or city licensed operators shall furnish <br />residential trash collection services as provided in this section for all residents <br />within the city, except those specifically excluded in section 8.64.070. <br />B. All trash shall be placed in trash containers as provided in section <br />8.64.020 by the owner, tenant or occupant of each residence. Containers shall be <br />4 <br />16 <br />
