Incident Report - Henry's (8/2/03) <br /> <br />Detective Gordanier brought Officer Josh Bonafede to the meeting to answer any <br />questions the Authority might have regarding this incident report. The Authority <br />felt it was a very thorough report and did not have any questions for Bonafede. <br /> <br />Paige moved to schedule a Show Cause Hearing for serving to intoxicated <br />persons and serving while intoxicated. Mulvahill seconded. Roll Call Vote: <br />Lipton-yes, Koertje-yes, Kimmett-yes, Paige-yes and Wilson-yes. All were in <br />favor, motion carried. <br /> <br />Lipton made a motion to have Mark Shapiro serve as attorney to the Authority for <br />the Show Cause Hearing. Paige seconded. Roll Call Vote: Lipton-yes, Koertje- <br />yes, Kimmett-yes, Paige-yes and Wilson-yes. All were in favor, motion carried. <br /> <br />Mulvahill made a motion to set the Show Cause Hearing for September 29, 2003 <br />at 7:00 p.m. Kimmett seconded. Roll Call Vote: Lipton-yes, Koertje-yes, <br />Kimmett-yes, Paige-yes and Wilson-yes. All were in favor, motion carried. <br /> <br />B. Incident Report- Blue Parrot (7/21/03) <br /> <br />Wilson commented on how thorough the report was and appreciated Detective <br />Gordanier's additional work regarding this matter. <br /> <br />Gordanier told the Authority she might be able to subpoena the initial blood draw <br />done on the deceased at the hospital as well as the quantity of cocaine in his <br />system. <br /> <br />The Authority discussed how much more of an effort Gordanier should put into <br />obtaining the test results. Authority attorney Bleau stated with the addition of the <br />cocaine, it may confuse the issue of whether or not the deceased was visibly <br />intoxicated. The blood alcohol level is not enough evidence to go forward with a <br />Show Cause Hearing. <br /> <br />Wilson commented that a person must show signs of intoxication and according <br />to witnesses; there were no signs of intoxication.
