Louisville Local Licensing Authority <br />Meeting Date: October 27, 2003 <br />Page 3 of 6 <br /> <br />Chairperson Lipton called the Show Cause Hearing to order and called for the parties to <br />enter their appearances for the record. Special Prosecutor Mark Shapiro, representing <br />the City of Louisville Local Licensing Authority, stated he had discussions with Mr. <br />Johnson, Attorney of Record for Henry's Bar & Grill, and they have reached an <br />agreement. Mr. Shapiro reviewed the Stipulation and Agreement, included a seven-day <br />suspension, with two days served and five days held in abeyance for a period of one <br />year. <br /> <br />There was Authority discussion relative to which days the establishment would be <br />suspended. Authority Attorney Tiffanie Bleau suggested continuing the matter to the <br />next regular meeting when the Finding and Order can be finalized and the two-day <br />suspension can be determined by the Authority. <br /> <br />Mulvahill moved that the Authority Attorney prepare an Order incorporating the terms <br />agreed upon by the City and the licensee for consideration at the next regular meeting <br />of the Authority and continue that matter until such meeting. Wilson seconded. Roll call <br />vote: Wilson -yes, Lipton -yes, Koertje -yes, Mulvahill -yes, Kimmett - yesl Motion <br />carried. Paige absent. <br /> <br />Mulvahill moved the Authority approve the Stipulation and Agreement and it be <br />incorporated into the Finding and Order as prepared for the next regular meeting. <br />Kimmett seconded the motion. Roll call vote: Wilson -yes, Lipton -yes, Koertje -yes, <br />Mulvahill -yes, Kimmett - yes. Motion carried. Paige absent. <br /> <br />Lipton moved the Authority determine the two-day suspension for Henry's Bar & Grill at <br />the next regular meeting. Mulvahill seconded. Roll call vote: Wilson-yes, Lipton-yes, <br />Koertje-yes, Mulvahill-yes, Kimmett-yes. Motion carried. Paige absent. <br /> <br />Liquor License Transfer - Louisville Liquors, LLC - Retail Liquor Store License - <br />1140 Pine Street, Ste. 1. <br /> <br />Chairperson Lipton called for Authority questions on the transfer application. <br /> <br />Mulvahill asked City Clerk Varra if the FBI fingerprint reports have been returned. City <br />Clerk Varra reported that one applicant was fingerprinted in Westminster and one <br />applicant was fingerprinted in Louisville. Neither CBI fingerprint report has been <br />received. Varra also reported the Authority Attorney identified omissions and confusing <br />information on both applicants individual histories. Varra noted she had spoken to one <br />of the applicants and was told the information would be forwarded, however, that <br />information to date, has not been received. <br /> <br />Lipton moved that the Authority continue the Liquor License Transfer for Louisville <br />Liquor, LLC to the next regular meeting. Wilson seconded. Roll call vote: Wilson-yes, <br />Lipton-yes, Koertje-yes, Mulvahill-yes, Kimmett-yes. Motion carried.
