RESOLUTION NO. 04 <br /> SERIES 2010 <br /> A RESOLUTION RECOMMENDING APPROVAL OF A PRELIMINARY SUBDIVISION <br /> PLAT AND A PRELIMINARY PLANNED UNIT DEVELOPMENT (PUD) <br /> DEVELOPMENT PLAN FOR THE CONOCOPHILLIPS CAMPUS <br /> WHEREAS, there has been submitted to the Louisville Planning Commission an <br /> application for approval of a preliminary subdivision plat and preliminary (PUD) <br /> development plan for the proposed ConocoPhillips Campus development on a 390.013 <br /> acre parcel of land located in the southeastern corner of Louisville; and <br /> WHEREAS, the City Staff has reviewed the information submitted and found <br /> that, subject to conditions, the application complies with the Louisville zoning and <br /> subdivision regulations and other applicable sections of the Louisville Municipal Code; <br /> and <br /> WHEREAS, the Planning Commission held duly noticed public hearings on the <br /> application on February 11, 2010, and February 25, 2010 where evidence and <br /> testimony were entered into the record, including without limitation the findings in the <br /> Louisville Planning Commission Staff Reports dated February 11, 2010, and February <br /> 25, 2010; and <br /> WHEREAS, based on the evidence and testimony in the record, the <br /> Planning Commission finds that the application complies with the Louisville zoning and <br /> subdivision regulations and other applicable sections of the Louisville Municipal Code; <br /> and that said preliminary subdivision plat and preliminary PUD should be approved, <br /> subject to the following conditions: <br /> 1. The applicant will continue to work with staff to resolve the following issues for <br /> final submittal: <br /> a. Planning Commission is concerned with the location, quality and quantity <br /> of the proposed public land dedication. ConocoPhillips must resolve <br /> public land dedication requirements pursuant to section 16.16.060.B of <br /> the Louisville Municipal Code. If a building height waiver is granted <br /> pursuant to section 17.28.110, ConocoPhillips must provide additional <br /> land, fee-in-lieu-of and/or combination of in-kind services than is normally <br /> required within the Municipal Code. ConocoPhillips must engineer, <br /> design, construct and landscape land dedicated to the City of Louisville <br /> commensurate with standards for landscape within their private campus <br /> and subject to reclamation standards of the City of Louisville. <br /> b. Setbacks for the structures on the property shall comply with those <br /> delineated by the Planning Areas shown on sheet 2 of 12 in the <br /> Preliminary PUD Development Plan. In addition, any structure proposed <br /> with a height over the maximum building height permitted by the <br />
