Scholfield, Wilson & Company, 999 18th Street, Suite <br />2600, Denver, CO explained the original design was prepared with reduced clearance, <br />and received railroad approval. He noted the railroad then stipulated the reduced <br />clearance was not acceptable. On August 20, 2003, they met with the railroad and asked <br />for a compromise solution, which would allow for the new design. He noted it required <br />the redesign of an outside pier, moving the ditch back behind the pier to permit more <br />space for the railw~iy expansion, and a design for a new retaining wall. <br /> <br />MOTION: Sisk moved that Council approve the Amendment of Profession Engineering <br />Service Agreement for the Highway 42/96th Street project, seconded by Van Pelt. <br /> <br />Brown asked if the design would accommodate the commuter rail. Phare stated his <br />understanding it would accommodate up to three rails. <br /> <br />VOTE: Roll call vote was taken. The motion passed by a vote of 7-0. <br /> <br />RESOLUTION NO. 26, SERIES 2003 - A RESOLUTION APPROVING AN <br />AGREEMENT BETWEEN THE CITY OF LOUISVILLE AND THE NORTHERN <br />COLORADO WATER CONSERVANCY DISTRICT TO RELOCATE THE <br />DISTRICTS'S PIPELINE <br /> <br />Davidson called for Staff presentation. <br /> <br />Public Works Director Tom Phare explained the agreement between the City of <br />Louisville and'Northern Colorado Water Conservancy District would relocate the <br />District's pipeline. The District's raw water pipeline provides water to the Town of <br />Superior and crosses 96th Street on the south end of the MedTec property. Because of the <br />cuts placed on the existing crossing of the railroad, the pipeline must be relocated. The <br />pipeline will be relocated on the east side of the rail through an easement obtained from a <br />lot owner in CTC. Staff requested Council approval and authorization for the Mayor to <br />execute the Agreement. The relocation is necessary to complete the South 97th Street By- <br />Pass improvements and the costs associated with the relocation of the pipeline have been <br />included in the South 96th Street project budget. <br /> <br />MOTION: Brown moved that Council approve Resolution No. 26, Series 2003, and <br />authorize the Mayor to execute an Agreement to Relocate the Northern Colorado Water <br />Conservancy District (NCWCD) Pipeline, seconded by Sisk.
