Louisville City Council Meeting <br />September 2, 2003 <br />Page 4 of 9 <br /> <br />AUTHORIZE PAYMENT TO BOULDER COUNTY PURSUANT TO <br />MAYHOFFER SECTION 15 INTERGOVERNMENTAL AGREEMENT <br /> <br />Davidson called for Staff presentation. <br /> <br />Finance Director Charlene Laus reviewed the Mayhoffer Section 15 Intergovernmental <br />Agreement between the Cities of Louisville, Lafayette, and Boulder County. The <br />agreement states the City of Louisville will purchase an undivided 25% fee interest in the <br />Mayhoffer Section 15 property from the County within three (3) months after receiving <br />payment from the Northwest Parkway Authority that is expected in 2008. The initial cost <br />of the City's share of this property was $751,592 and the agreement includes a <br />5% per annum price escalation. The purchase price in 2008 is $1,057,566, however the <br />City has the option of making an early purchase of this property at significantly lower <br />cost price. According to the schedule, the 2003 purchase price is $828,630. Current <br />estimates after this purchase are that the Conservation - Land Acquisition Fund will end <br />the year with approximately $1.57 million available for other purchases. <br /> <br />COUNCIL COMMENTS <br /> <br />Davidson stated the Finance Committee reviewed this matter and favors an early payoff. <br /> <br />MOTION: Davidson moved that Council authorize payment to Boulder County in the <br />amount of $828,630 for the Mayhoffer Section 15 Intergovernmental Agreement, <br />seconded by Sisk. All in favor. <br /> <br /> APPROVAL OF AMENDMENT TO PROFESSIONAL ENGINEERING <br />SERVICE AGREEMENT FOR HIGHWAY 42/96TH STREET PROJECT <br /> <br />Davidson called for Staff presentation. <br /> <br />Public Works Director Tom Phare reported the City and Wilson & Company have <br />worked closely with the Burlington Northern Sante FE (BNSF) railroad to develop a <br />railroad bridge design that would meet with their approval, and could be incorporated <br />into Railroad Crossing Agreement with the BNSF. This process led to two-pier bridge <br />design, which was formally presented and accepted by BNSF. Wilson & Company <br />proceeded with final design of the bridge structure. In making their final review of the <br />bridge design, BNSF notified Wilson & Company they would need additional clearances <br />between piers to accommodate future tracking needs. Because all aspects of the bridge <br />design were completed at the time of notification, a significant amount of redesign is <br />required. Wilson & Company is requesting $67,000 on a time and materials basis to <br />complete this design effort and anticipates it will take 4 to 5 weeks to complete. Phare <br />noted earlier this summer Staff directed Wilson & Company to redesign the segment of <br />South 96th Street, extending from Paradise Lane to Dillon Road. They agreed to <br />complete this work on time and materials basis in an amount not to exceed $20,000. <br /> <br />4 <br /> <br /> <br />
