Louisville Local Licensing Authority,
Meedng Date: February 25, 2002
Page 5 o£ 6

B. Incident Reports - Druid Arms (02/01/02 & 02/10/02)

The Authority Members came to the conclusion that no liquor violations occurred.

SECRETARY'S REPORT

Deputy City Clerk' Schmidt introduced Prosecuting Attorney Martin Staab to the
members.

AUTHORITY ATTORNEY'S REPORT

No report.

AUTHORITY COMMENTS

Member Wilson had questions regarding the By laws, specifically Article 8, referring to
investigation procedures of applicants. She was concerned about the moral standing of
applicants and thought the By laws regarding conviction of a crime were overly broad.

Attorney Light stated that because of the lag time involved in getting fingerprint
verifications back from the state, the Authority looked for a way to allow applications to
move forward, notwithstanding the fact that results had not come back from the state.
This By law allows the Authority to take action on an application, if the application
submitted is complete. If applicants were misleading or provided false statements, the
Authority could call the application back up.

Member Kimmett addressed Attorney Light regarding the By laws with respect to
serving suspension dates. He asked that suspension dates to be served within thirty
days of notice of closure.

Attorney Light stated that there were no rules of procedures for closure, but under state
law, the Authority may impose a condition regarding a time limit. Attorney Light
suggested the Authority could change the procedural rules to give the applicant more
notice that a suspension must be served within a specific time. All members were in
favor of amending the rules to reflect the time limit imposed on serving suspension
dates.

Member Sackett expressed her concern regarding several establishments, stating that if
closed for any given time it would put them out of business. Member Koertje stated that
if a business is well run, it will survive economically.

Member Koertje stated that it would be nice to receive an e-mail reminder from the
Authority Secretary on the Friday before the Local Licensing Authority Meeting. Deputy
City Clerk Schmidt stated that she would e-mail the members.

5
! ,:',, LI Q U OI,U, 20~ )2 \ imf N UTI~S x, MIN UTIiS0225~t2.DOC
