Louisville Local Licensing Authority <br />Meeting Date: May 13, 2002 <br />Page 4 of 4 <br /> <br />Member Wilson had a question regarding the fine in lieu of suspension and the <br />time limit that would be imposed. She stated that establishments have 30 days <br />to serve a suspension but only 14 days to pay a fine. Attorney Harrington <br />clarified the time limit stating that 14 days or less is the period of suspension <br />imposed for which the licensee may request to pay a fine in lieu of serving the <br />suspension. If a 15-day suspension is imposed, it must be served. There is no <br />option of paying a fine. <br /> <br />Member Kimmett asked if the fine calculation set forth in the ordinance was <br />standard around the communities. Attorney Harrington noted that state statute <br />controls the amount of fine: "The fine accepted shall be the equivalent to 20% of <br />licensees estimated gross revenues from sales of alcohol during the period of the <br />proposed suspension except the fine shall not be less than $200 no more than <br />$5,000." Attorney Harrington also stated that only establishments that had not <br />had violations within the last two years would be eligible to pay a fine in lieu of <br />suspension. <br /> <br />Member Wilson asked if the new ordinance could be put in the next issue of the <br />Liquor Lore.
