COLORADO • SINCE 1878 <br />City0f Department of Planning and Building Safety <br />Louisville 749 Main Street • Louisville CO 80027. 303.335.4592 • www.louisvilleco.gov <br />To: Open Space Advisory Board <br />From: Department of Planning and Building Safety <br />Subject: Development Review Overview <br />Date: September 12, 2018 <br />Summary <br />City Planning staff will be making a presentation on the City's development <br />review process so that OSAB has a better understanding of the overall process <br />and OSAB's role in the process. For background, there are two main Municipal <br />Code sections that will provide guidance on many open space issues, depending <br />on the scope of the application. The first, Sec. 16.16.060, relates to public land <br />dedications that the City requires for all new subdivisions: A second Code <br />section, Sec. 17.28.110, relates to when an applicant requests a waiver or <br />variance from a zoning requirement. Each code section follows, and staff will <br />facilitate a more in-depth conversation on each during the meeting. <br />Sec. 16.16.060. - Public use dedications shall be as follows: <br />1. A minimum of 12 percent for nonresidential subdivisions and a <br />minimum of 15 percent for residential subdivisions of the total land <br />area of the tract being subdivided shall be dedicated, exclusive of <br />subsection A of this section, for park, school, or other public <br />purposes as determined by the city council and shall be <br />delineated on the final plat. Land dedicated for public use must be <br />suitable, as determined by the planning commission, for the type <br />of development and/or the use for which it is intended. <br />2. If the city council so determines, the subdivider shall pay to the <br />city in cash an amount equal to the applicable percentage <br />established in subsection B.1 of this section of the total appraised <br />value of the land to be subdivided in lieu of the dedication of land <br />required in this section. Any appraisal required to establish the <br />value of land in this section shall be done at the expense of the <br />subdivider. <br />3. In determining which of the above policies to implement, the <br />planning commission and the city council will consider the size of <br />the development and its adequacy for accommodating a suitable <br />public use site; the community facility aspects of the <br />comprehensive development plan and the school district's master <br />plan; existing parks and other public uses in the area; the <br />9 <br />
