11: City,/ <br />im Louisville <br />COLORADO • SINCE 1878 <br />LOUISVILLE REVITALIZATION <br />COMMUNICATION <br />SUBJECT: <br />DATE: <br />LRC LEGAL SERVICES CONTRACT <br />OCTOBER 8, 2018 <br />PRESENTED BY: AARON DEJONG, ECONOMIC DEVELOPMENT <br />KATHLEEN KELLY, CITY ATTORNEY <br />SUMMARY: <br />The City's legal counsel previously notified the City and LRC of a fee increase and <br />changes at the firm. In particular, Sam Light has left Light I Kelly P.0 to become in- <br />house General Counsel for CIRSA. Effective October 1, the firm name changed to Kelly <br />PC and partner Kathleen Kelly is serving as lead attorney for the City's legal work. In <br />addition, Dianne Criswell, former Legislative Counsel with the Colorado Municipal <br />League, joined the firm on September 13 as a senior associate. Regarding fees, the <br />firm has proposed an increase in partner and associates rates effective January 1, <br />2019, and the addition of a senior associate rate effective September 2018. <br />On September 17, City Council approved a new contract with the firm to reflect <br />Kathleen Kelly serving as the lead City Attorney, as well as the new firm name and rate <br />changes. The LRC as a separate legal entity has maintained a separate contract with <br />the firm. The attached updated contract is proposed to reflect the same name, rate and <br />principal attorney changes for LRC legal services. <br />FISCAL IMPACT: <br />The rate changes will be reflected in LRC's 2019 operational budget. <br />RECOMMENDATION: <br />Staff recommends approval of the revised LRC Contract for Attorney Services reflecting <br />the new name of the law practice, the role of Kathleen Kelly as the primary counsel, and <br />the fee increase. <br />ATTACHMENT(S): <br />1. 2018 Revised Contract for Attorney Services <br />2.
