LCity,f <br />Louisville <br />Parks & Recreation <br />Memorandum <br />To: Parks and Public Landscaping Advisory Board <br />From: Dean Johnson, Parks Superintendent <br />Date: 10/22/2018 <br />Subject: Discussion and Direction on Consideration of Changes in Liquor Regulations and <br />Options in Parks <br />Purpose: <br />The City of Louisville's Legal Review Committee has requested that the Parks and Public <br />Landscaping Advisory Board discuss and provide direction on which is PPLAB's preferred option <br />listed under the section, "Next Steps". <br />Background: <br />The City's current rules prohibit the consumption of alcohol in the parks. The only exception to <br />that rule is an event with a liquor license such as Razzle Dazzle or Pints in the Park. In the last <br />legislative session, the legislature amended liquor rules to now include the following beginning <br />January 1, 2019: <br />C.R.S. 44-3-901(i)(I)(D)(VII) .. It is not unlawful for a person who is at least twenty-one <br />years of age to consume any fermented malt beverage or malt, vinous, or spirituous <br />liquor in any public place, other than a public right of way, where consumption of the <br />fermented malt beverage or malt, vinous, or spirituous liquor has been specifically <br />authorized by ordinance, resolution, or rule adopted by a municipality... <br />Staff would like to take PPLAB's opinion to the City Council's legal committee so it can consider <br />whether or not to recommend changes to the park rules to allow more leniency for alcohol <br />consumption. <br />Previously the Louisville Municipal Code allowed for up to five hours of alcohol use in a park as a <br />part of a park rental (exclusive use permit) and with the permission of the Parks & Recreation <br />Director. This was solely for use by private individuals and did not include sales. <br />The Parks Board had a brief discussion about this option earlier in the year. They did not take a <br />position but did feel the City Council should consider this. The Police Department does not <br />support allowing liquor in the parks and feels it will be difficult from an enforcement stand <br />point. <br />Next Steps: <br />PPLAB to select one of the options listed below for report back to the Legal Committee: <br />1. Keep existing rules banning the use of alcohol in the parks; <br />2. Amend the Code to allow alcohol use in the parks with conditions. A permit could be <br />required, limits could be placed on time, place, types of liquor, etc. <br />3. Allow consumption of alcohol in parks. <br />7 <br />
