Regarding the setback variance, the <br />applicant felt setbacks are established to limit the massing of buildings and prevent encroachment onto <br />rights-of-way or adjacent properties. They felt they had been successful in meeting this by keeping <br />the scale of the project low in terms of ground cover, the percentage of open space to floor space, <br />and limiting the facility to a single-story building. <br /> <br />Sisk inquired if the land purchase for this facility has been completed. <br /> <br />Taft responded that the land has not been purchased. <br /> <br />Sisk questioned whether any mortgagee of the second lot would be required to sign off on the <br />property in order for the City to maintain position as a third-party beneficiary to the easement <br />agreement. <br /> <br />Sam Light, City Attorney, responded the current easement agreement did require the mortgagee to <br />sign off on the property. <br /> <br />Sisk requested this issue be resolved before proceeding. <br /> <br />Dick Taft agreed to have the easement agreement in place prior to mortgaging the property. <br /> <br />Sisk questioned whether the letter received by Paul Wood from Don Orr was sufficient to satisfy <br />condition No. 1. <br /> <br />Sisk and Howard requested a formal agreement with the BVSD be in place prior to issuing a <br />certificate of occupancy. <br /> <br />Taft agreed and stated it would be prior to recording the PUD. <br /> <br />Howard raised concerns that Council approval for the setback variances would set a precedent for <br />future applicants requesting variances for similar reasons. The fence height variance was offset by the <br />substantial landscaping proposed. Howard questioned the roofing requirement variance. Dick Taft <br />explained the noise created from rain and hail on a metal roof becomes an issue when caring for <br />Alzheimer's patients as they are significantly impacted by unrecognizable/unidentifiable noises. <br />Howard felt this was reasonable, but also expressed concern for the parking and setback variances. <br /> <br />Levihn questioned the wording in the proposed parking agreement faxed to Don Orr on September <br />25, 1997. The last paragraph of that agreement allowed them to cancel at any time with a 30-day <br />notice. <br /> <br />Taft agreed to contact Don and request eliminating that statement. <br /> <br /> <br />
