Leonard Fineburg, 303 17th Avenue, Suite 920, Denver, CO 80203, representing Coal Creek Medical <br />Campus (Lot 2 adjoining the applicant's property), was present to identify their concerns. He <br />informed the Council that the cross-easement portion of the property, which included the City's right <br />for emergency access through Lots 1 & 2, had a clear deed of trust; therefore, the owners can grant <br />access without lender's consent. The first concern was the encroachment of the setback on the <br />property line. Wellspring had explained the need for their plan to encroach on our property due to <br />the configuration of their building. Coal Creek Medical Campus was not opposed to the plan, their <br />concern involved the future plans to construct a two-story medical office building on Lot 2. The <br />second story of the building might provide a view into the living areas of Wellspring's residents due <br />to the close proximity of the two buildings. If this would create difficulties for their future <br />development plans, Mr. Fineburg preferred to address these concerns now. The second concern <br />related to the access through Lot 1. The Planning Department and Planning Commission requested <br />they extend sidewalks across the property up to the property edge of Lot 1. They wanted the cross- <br />easement agreement to include pedestrian access as well as vehicular access to ensure children have <br />safe access to the elementary school. The third concern dealt with the fencing along the property line. <br />The owner appreciated the mitigation to the fence along the property line between Lots 1 & 2, in <br />addition to the fence along 88th and Campus Drive. However, along their property line, it is just one <br />straight fence. They requested the applicant pull back the fence and include additional landscaping. <br /> <br />Davidson called for Council questions or motions. <br /> <br />Keany expressed his approval for the esthetics of the building, but wanted clarification of the fence. <br /> <br />Davidson requested the BVSD follow regular procedures to obtain approval for a sign on 88th Street. <br /> <br />Mayer and Howard were concerned about how the setback variances affected future owners of the <br />property, and requested a firm parking agreement be reached with the BVSD prior to approval. <br /> <br />Sisk moved that Council approve Resolution No. 55, Series 1997, with the following amendments: 1. A shared parking agreement with Boulder Valley School District be executed prior <br /> to issuing a building permit. <br /> 2. Would remain as written. <br /> 3. The applicant modify the PUD, granting emergency access prior to the recording of <br /> the PUD. <br /> 4. The general notice be changed to reflect location as being within the City of Louisville <br /> rather than within Jefferson County. <br /> 5. Delete any reference to a sign for the Boulder Valley School District at the corner of <br /> 88th Street and the future east/west street. <br /> 6. The plan would include an alignment for sidewalks and vehicular traffic with the <br /> adjacent lot. <br /> 7. The required setback of twenty feet be adhered to for the north side. <br /> <br />Howard seconded. All in favor. <br /> <br /> <br />
