Section 1. The title of Chapter 8 64 is hereby amended from "RESIDENTIAL REFUSE AND RECYCLING COLLECTION" to "RESIDENTIAL REFUSE, RECYCLING AND COMPOSTABLE MATERIALS COLLECTION" Section_2. Section 8 64 010 of the Louisville Municipal Code is hereby amended to read as follows (words added are underlined, words deleted are stti$len-threugh) Sec. 8.64.010. - Definitions. For the purpose of this chapter, unless the context clearly requires otherwise, the following words and terms shall have the following meanings. Compostable materials means discarded materials from any residential or commercial source that are collected separately for the purpose of being composted, or otherwise processed into soil amendment, fertilizer, mulch, sludge, biogas, fuel or electricity. Compostable materials container means a wheeled cart suitable for mechanical lifting with a lid for containing and setting out compostable materials for collection in sizes of approximately 32-gallons, 64-gallons, and/or 96-gallons. Construction and Demolition materials means the waste materials produced in the process of construction, renovation or demolitionof structures (including buildings, bndges and _roads). Components include materials or debns such as asphalt, concrete, dimensional lumber, fiberboard, plywood, ferrous metals, non- ferrous metals, asphalt shingles, cardboard, carpet, brick, plastic and cardboard. Hauler means person or company that collects, transports or disposes refuse, recycling, compostable, or construction and _demolition materials for another, for a fee or for no fee, except as_exempted in section 8.64.120. Homeowners' association means any covenant -controlled community containing two or more residential property owners, which includes a lawfully constituted and operational board or other similar entity which is empowered to enforce the community's recorded covenants and which has the power to impose assessments for its services which, if unpaid, may be made a lien on the property Recycling materials means discarded materials from any residential or commercial source that are collected separately for the purpose of such materials being re -processed into new or different products or packaging matenals, provided that such materials have been designated as recyclable pursuant to section 8 64 045 Refuse means any form of waste discarded matenal, junk, garbage, rubbish, trash, foreign substance, yard waste or debns , intended for landfill disposal, excluding recycling, compostable, and constructionand demolition materials.
