The applicant requests a variance from Section 17.20.020 of the Louisville Municipal Code <br />requirement for two off-street parking spaces for a new residential structure. The applicant <br />recently demolished an existing home that did not have two off-street parking spaces, <br />however the LMC requires these spaces be provided for the new residential structure. The <br />applicant requests a variance from this provision so that they are not required to construct <br />these two off-street spaces. <br />BACKGROUND: <br />The subject property is zoned Residential Low Density (RL) and is within the Old Town <br />Overlay. The applicants recently received approval of building permits to demolish the <br />existing home and construct a new single-family residence. With the exception of the <br />provision requiring two off-street parking spaces, the application complies with all zoning <br />requirements. Staff approved the building permit with a site plan that can accommodate <br />these two off-street parking spaces, however due to the configuration of the property, the <br />applicant is requesting the variance in order to maintain the previous condition. If the <br />variance is approved, the applicant will not be required to construct these spaces. <br />The property is located in the Jefferson Place subdivision, which was platted in 1905. This <br />plat provided an alley along the north side of the properties fronting Walnut St. The City <br />vacated the alley at the request of the property owners along Walnut St in 1982. Over time, <br />a number of these east -west alleys have been vacated by the City. The applicants owned <br />the property at 709 Walnut at the time of the vacation request, but did not contemplate <br />redevelopment of the property. <br />Current City regulations for Old Town require vehicular access to take place from an alley <br />when alley frontage is present. This limits the number of driveway connections and vehicular <br />conflicts with pedestrians, thus, improving the walkable character of Old Town.
