Board of Adjustment <br />Meeting Minutes <br />December 21, 2016 <br />Page 2 of 6 <br />DeJong reviews the procedures for the meeting; opens the public hearing; and states <br />there are six criteria which must be met for the board to approve a variance request. <br />DeJong states that for the variance to be approved, four (4) of the five (5) votes would <br />need to be affirmative. <br />DeJong then states that copies of the criteria are located on the table next to the <br />entryway. He asks for verification of the completion of the application. <br />Ritchie confirms that the application requirements have been satisfied. <br />Levinson makes a motion that all requirements have been satisfied and the application <br />submitted by the applicants has been properly filed. Stuart seconds. Motion passes by <br />unanimous voice vote. <br />DeJong asks if anyone at the hearing has any objections to the hearing procedures he <br />described and asks if there were any other preliminary matters that needed to be taken <br />care of. None are heard. <br />Conflict of Interest and Disclosure: <br />DeJong then asks for conflicts of interest from the board members. All board members <br />indicate they do not have any disclosures for the application. <br />DeJong asks the applicants if they are ready to proceed with the hearing. Bradley <br />Latham, representing Mackenzie Latham, indicates that he is ready to proceed. <br />DeJong asks for confirmation of public notice. <br />Ritchie states that public notice was posted on June 29 2018 and in the Boulder Daily <br />Camera on July 1, 2018. <br />Staff Report of Facts and Issues: <br />Ritchie reviews the location of the property, which is in Coal Creek Neighborhood in a <br />RE zone district. The proposal is to replace a deck that is failing structurally with a <br />slighter larger deck. Since the applicant is requiring a slightly larger deck and not <br />replacing like -for -like, they require a variance. She also presents the plans for the new <br />deck and points out the email of support from a neighbor included in the staff packet. <br />Staff Recommendations: <br />Staff recommends approval of the request. <br />Board Questions of Staff: <br />Stuart asks why the application did not qualify for an administrative approval. <br />Ritchie replies that administrative approvals were for like -for -like replacements. <br />
