During the hour and one-half hour the seven people were not voiceterous. Mr. Beranato asked what kind <br />of food and drinks were ordered. Ms. Armstrong said that they ordered ten or twenty wings it would <br />have totaled with tax 8 to 10 dollars, couple pitchers of beers and two tuwalka. There was no other shots <br />ordered. The patrons did not cause any problems with any of the other customers, they did not knock <br />over plates or glasses, they did not cause any type of disturbance during the hour and one-half. Two <br />individuals grabbed each other by the shirts and within seconds staff members went over to try and break <br />it up as Ms. Armstrong was yelling for them to stop she was calling the police. As soon as Ms. <br />Armstrong yelled someone else from the staff hollered call the police. The fight broke up immediately. <br />The two individuals fighting were very appologetic to everyone. <br /> <br />Beranato questioned Armstrong and established that three officers were at the establishment (Armstrong <br />pointed to Jerry Riggins, Richard Anderson, and Joe Burtness). Mr. Beranato asked whether at any time <br />during the investigation did any officer question Mr. Hayden and Ms. Armstrong's answer was n and at <br />no time did Mr. Hayden approach the police officers <br /> <br />Ms. Abeyta was upset that officers were talking to her friends, but Ms. Armstrong said that she showed <br />no visible signs of intoxication. Ms. Armstrong testified that none of the individuals showed any signs <br />of intoxication, staggering or any trouble walking during the entire incident. <br /> <br />$42.00 including 20% gratuity for seven people for an hour and a half. 20% was because Ms. Armstrong <br />thought the patron would end up leaving and not paying the tab. <br /> <br />Mr. Beranato had no further questions. Mr. Beranato introduced Ms. Armstrong's training certificate to <br />be placed in exhibit. <br /> <br />Morris placed the training certificate as Exhibit No. 1 <br /> <br />VI.
