ARMSTRONG:

No, not that I could tell. He questioned the amount because I didn't tell him that
I added in the twenty percent tip and he just wanted to know if everything that
was served at the table was added on the one tab and yes it was. There was no
cash paid to me, there was no other tab, it was one tab for seven people.

JOSS:

This person wasn't having any problem with slurred speach or staggering as they
walked or anything like that?

ARMSTRONG: Not that I noticed. He was mad.

JOSS:

At the time that this altercation occurred was the owner of the establishment, Mr.
Hayden present?

ARMSTRONG: Yes.

JOSS:

Where was he located?

ARMSTRONG: Back by the pool table in a chair.

JOSS:

Was he intoxicated or had he been drinking on this evening.

ARMSTRONG:

He had a couple of beers, but intoxicated, no I would not say he was intoxicated,

no.

JOSS:

You arrived at the establishment at approximately 4:30 p.m. was Mr. Hayden
there when you arrived?

ARMSTRONG:

No. I have no clue when he came in. When I am working, I'm working my
tables, I'm not watching to see who comes in at what time. I cannot specify what
time he came in.

JOSS:

Your recollection is that he had a couple of drinks.

ARMSTRONG: Right, he was playing pool.

Joss ended his questioning of this witness.

Beranato showed Ms. Armstrong Exhibit #1 (attached), and asked her what it was. Ms. Armstrong
explained that it was a certificate of training which she had recieved from the City of Louisville. The
certificate shows that Ms. Armstrong had completed the training course in 3.2 Beer and Liquor Code
regulations. Ms. Armstrong had completed the four hour course on February 26, 1995. Mr. Beranator
asked Ms. Armstrong if part of the training session covered visible signs of intoxication, including slurred
speach, blood shot eyes, inability to walk or staggering and that indication would also include ordering
doubles, playing drinking games, animated speech. Mr. Beranato asked if any of the seven people
showed any of the signs discussed. Ms. Armstrong said no, that they were very cooperative.
