AUTHORITY BUSINESS <br /> <br />Ae <br /> <br />Show Cause Hearing - Hei Han Enterprises, Inc., d/b/a Henry's Bar & Grill - 935 <br />Pine Street - Louisville, CO 80027 <br /> <br />Motion to Approve Stipulation and Agreement Concerning Show Cause Order <br />Issued to Hei Han Enterprises, Inc., dfo/a Henry's Bar & Grill - 935 Pine Street - <br />Louisville, CO 80027 <br /> <br />Jeffers called for the Attorney representing the City's presentation. <br /> <br />Steve Barnett, attorney representing the City of Louisville - 824 Pine Street, Louisville, CO 80027, gave <br />a brief summary of the proposed Stipulation and Agreement Concerning Show Cause Order for Hei Han <br />Enterprises, Inc. d/b/a Henry's Bar & Grill - 935 Pine Street, Louisville, CO 80027. The proposed <br />settlement involves a 17 day suspension of the license or closure of the premises, which is a significant <br />amount of time. Three of the 17 days are days that were held in abeyance from a previous incident. The <br />14 days with respect to this matter is within the Authority's guidelines for a second offense for an <br />establishment of this type. Henry' s has agreed to the proposal and has signed it and has been quite <br />cooperative in arriving at that stipulation. Henry Yen is in attendance and is represented by Counsel and <br />is available to answer any questions. <br /> <br />Jeffers called for any comments from the applicant or his attorney. <br /> <br />Eric Johnson, Hirst, Yeager & Sisk, attorney representing the applicant, Hei Han Enterprises, Inc. (Henry <br />Yen). Mr. Johnson and Mr. Yen feel that it is an appropriate sanction for the second violation of the <br />code. Mr. Johnson gave a brief history of the two violations. Mr. Johnson explained that Mr. Yen <br />understood the seriousness and the nature of the first violation, he did, however, under estimate the <br />nature of the influx of problems into Henry's with the closing of the Track Inn and other changes around <br />town. Mr. Yen acknowledges that he didn't take measures that was extreme enough to actually handle <br />all those problems and he has since immediately following the violations which have resulted in this <br />second stipulation has significantly reduced his hours, accordingly reduced his staff. Through those two <br />major changes the environment which produced the problems which resulted in these sanctions is <br />effectively dealt with at this time. There have been no further occurrences since the most recent episode <br />which is referenced in the Authority's packet. Henry is committed to working with the Authority to <br />insure that these types of problems don't occur again. Henry is in the process of redecorating the interior <br />of the building, has increased the menu and the hours of service. Those employees who were involved <br />in violating the code are no longer employed by Henry' s. With the changes there has been a drastic shift <br />in the clientele, but there has been an increase in lunch time crowds. Mr. Yen also proposes to hire a <br />manager to run the business during hours he is not able to be at the tavern. <br /> <br />Jeffers called for any other motions. <br /> <br />2 <br /> <br /> <br />
