Bo

Discussion/Motion - Request for Transfer of Hotel & Restaurant Liquor License from
Ona's Bistro, Inc. to Old Louisville Steak and Lobster House

Authority Secretary informed the Authority that the Old Louisville Steak and Lobster House had
received a temporary permit pending transfer and that both applicants have submitted fingerprints but no
reports have been received to date from C.B.I.

Jeffers asked the applicant if they had any comments or information they would like to share with the
Authority.

Applicants stated that there will be no changes to the premises. The applicants were unable to attend any
of the training sessions provided but would plan to attend the next session available to them. They will
not be opening until sometime in January 1998 and all of the staff will be required to attend.

Kimmett asked that the applicants please correct the drivers license information on their individual
history applications. The applicants need to provide the Secretary with their license numbers and the
state in which they are issued.

Jeffers called for any additional Authority comments or motion.

Co

Discussion/Motion - Set Hearing Date for Special Hearing for New Liquor License
Application for Hotel & Restaurant Liquor License for Karen's In The Country

Authority Secretary was contacted by Karen Mulholland, owner of Karen' s In The Country, on Wednesday,
October 22, 1997, who stated she had not received her renewal notice from the State of Colorado. Upon discussing
this matter with the State, the Secretary was first informed that the liquor license for Karen's In The Country had
been canceled in June of 1996 and that was the reason the applicant had not received a renewal notice. The
Secretary told the state employee that the Karen's In The Country's license was not canceled but that there had
been a transfer on the other license, Karen's located downtown. A supervisor then informed the Authority
Secretary that the Country license was no long valid because the license holder did not renew her license in 1996,
although, there had been a modification to premises approved in August of 1996. After questioning the supervisor
about what the employee had stated regarding the cancellation of the license - we were informed that was not true.

After lengthy discussion with the supervisor, the Authority Secretary contacted Sam Light, Authority Attorney, to
see if there was any possible way to reinstate the Karen's In The Country license effective immediately. Karen
stated that she had not been notified and the Authority Secretary had never been notified by the state questioning
the status of this particular license. Although the state is responsible for sending out renewal notices it is their
position that it is the license holders responsibility to know when their license expires. The Authority Attorney and
Authority Secretary contacted Matt Cook, Director of Licensing, to see if there was any possible way that the
license could be reinstated without going through the new application process. Mr. Cook stated it could not, due
to the elapsed time, but the state agreed to a concurrent review of the license so that upon approval of the Local
Licensing Authority the applicant could collected the state license that same day.
