City Council <br />Meeting Minutes <br />November 18, 2008 <br />Page 8 of 9 <br />The City Attorney requested the City Council convene an executive session for <br />the purpose of consultation with respect to pending litigation (Jerry Riggins v. <br />City of Louisville, et al., Civil Action No. 06-CV-022.6). <br />The City Manager requested the City Council convene an executive session for <br />the purpose of consideration of proposed real property acquisition and <br />disposition, as to value and strategy (Potential Purchase of Property for Public <br />Works Purposes and Sale of Excess City Property) <br />City Clerk Varra read Section 2.90.050 -Public Statement from the Louisville <br />Municipal Code, which governs the topics of discussion in an executive session. <br />City Attorney Light cited the authority for convening an executive session. <br />(Louisville Charter, Section 5-2(d) -Authorized Topics -Consultation with an <br />attorney representing the City with respect to pending litigation, and C.R.S. <br />Section 24-6-402(4)(b)) and Louisville Charter, Section 5-2(c) -Authorized <br />Topics -Consideration of real property acquisitions and dispositions, only with <br />respect to appraisals and other value estimates and strategy, anal C.R. S. <br />Section 24-6-402(4)(a)) <br />MOTION: Councilor Muckle moved the City Council convene an executive <br />session for the purpose of legal consultation, on pending litigation, seconded by <br />Councilor Sackett. All in favor. Absent: Councilor Dalton. <br />MOTION: Councilor Muckle moved the City Council convene an executive <br />session for the purpose of discussion property acquisition and disposition, <br />seconded by Councilor Clabots. All in favor. Absent: Councilor Dalton. <br />REGULAR BUSINESS ITEMS SUSPENDED <br />The City Council went into executive session at 8:05 p.m. The City Council <br />reconvened the regular meeting at 8:55 p.m. <br />REPORT -DISCUSSION/DIRECTION/ACTION -PENDING LITIGATION AND <br />PROPOSED PROPERTY ACQUISITION AND DISPOSITION <br />City Attorney reported in the executive session, City Council discussed proposed <br />property acquisition and disposition strategies. The City Attorney was given <br />direction. With respect the City of Louisville vs. Jerry Riggins, Council received <br />legal advice from the City Attorney. The City Attorney was given direction from <br />Council. <br />CITY ATTORNEY'S REPORT <br />City Attorney Light reported on the Hamon litigation. On October 2, the City <br />received an order from the Court, stating there was an enforceable claim in the <br />
