The second show cause order would be dismissed. The liquor <br />license would be suspended for 10 days with 5 held in abeyance. Employees <br />would need to attend training in the next 60 days and the licensee may apply for <br />a fine in lieu of suspension for the 5 days. There were 4 days held in abeyance <br />on the last agreement, which will now be served as active suspension November <br />25 — 28, 2019. <br />Machado wanted to know how this type incident would be addressed in the <br />future. Mr. Carr noted the establishment has provided video and information to <br />the police department since the first incident and will continue to do so in the <br />future if requested. <br />Brown noted his reservation about renewing this license at the last meeting due <br />to the seriousness of the show cause orders and hoped to not see the licensee <br />here on this type of matter again. <br />Brown moved to accept the stipulation as written, Machado seconded. Roll Call <br />Vote: Brown — yes, Machado — yes, Kaufman — yes. <br />Mr. Carr noted he would submit the calculations for the fine in lieu along with the <br />petition to the Authority secretary for consideration at the October 28 meeting of <br />the Authority. <br />C. Show Cause Hearing — Hei Han Enterprises Inc. d/b/a Henry's — <br />Tavern Liquor License — 935 Pine Street — 6/15/19 Incident <br />Special Prosecutor Gollin noted he thought Mr. Yen, owner of Henry's, wanted to <br />go to hearing without an attorney. The Authority confirmed with Mr. Yen that he <br />wished to go to hearing without his attorney. <br />Chairperson Machado called the show cause hearing to order. <br />Mr. Gollin noted he was ready to proceed. Chairperson Machado noted Henry <br />Yen was present and intended to proceed without an attorney. Machado <br />confirmed this with Mr. Yen. <br />Mr. Gollin asked the Authority to take judicial notice Mr. Yen was here as owner <br />and represented himself as holder of the liquor license. Machado noted the <br />Authority took judicial notice. <br />Machado made the show cause notice a part of the record. <br />Mr. Gollin called Jerimiah DeHerrera to the stand. DeHerrera noted he is a <br />Louisville police officer. He noted he was an officer on June 15, 2019, the date <br />of the incident. <br />
