Local Licensing Authority <br />Minutes <br />September 23, 2019 <br />Page4of8 <br />0 Officer DeHerrera took the oath and testified he was dispatched to a fight <br />on Pine Street which runs between Henry's and Tilt. When police arrived a few <br />individuals scattered. One individual was placed in custody and detained near <br />Pine and Main. People were running in the street and officers were stationed <br />throughout the downtown area. Four individuals were charged with a variety of <br />crimes. After detaining one individual Officer DeHerrera talked to the reporting <br />party, the bouncer at Henry's. Two individuals attempted to provoke someone to <br />fight at the rear entrance of Henry's. The bouncer asked them to leave but they <br />kept trying to sneak back in. <br />The bouncer reported one of the individuals he asked to leave was trying to fight <br />during the course of the night. He watched that individual leave Henry's and <br />engage two unknown individuals in a fight in the street. <br />Prosecutor Gollin reviewed the incident as reported in the police reports. Officer <br />DeHerrera reported one of those involved had hidden out on a rooftop and then <br />came back and approached the bouncer. The bouncer had not called the police <br />at this point. A female in the street tried to intervene and was swung at with a <br />knife by a person who later fled the scene and tried to enter a home and then did <br />enter another home nearby. He was faced by the resident of the home with a <br />firearm. The intruder exited. <br />One of the persons involved in the fight went to the hospital with lacerations to <br />the head. <br />Officer DeHerrera initiated a liquor investigation after the incident. He met with <br />the bouncer at Henry's and the bouncer reported it was not Henry's policy to call <br />the police until everyone was on their way out. <br />Mr. Yen noted the bouncer did call the police. <br />Mr. Gollin noted this hearing was about failure to report. The bouncer did kick out <br />some of those involved. Had the bar reported earlier perhaps the fight would not <br />have gotten to the point it did. He reviewed the intensity of this fight. Had the <br />police been called this might not have happened. He said it was concerning the <br />bouncer reported it was policy to get the persons out of the bar not necessarily <br />reporting. <br />Mr. Yen said he tells his staff to report fights to the police right away. He noted he <br />will discuss a policy to report right away with his staff. He stated the municipal <br />court dropped the case against the bouncer for failure to report. <br />Hearing closed. Machado called for Authority questions or deliberation. <br />
