ORDINANCE NOa /9; <br /> ,AN ORDINANCE ESTABLISHING AND REGULATING THE POLICE DEPARTMENT <br /> OF THE) TOWN OF LOUISVILLE, FIXING THE COMPENSATION OF DEPUTY MAR <br /> SHAL,' AND TO REPEAL ILL ORDINANCES OR PARTS OF ORDINANCES IN CON- <br /> FLICT OR INCONSISTENT HEREWITH. <br /> BE IT ORDAIN,t1) BY THE BOARD OF TRUSTEES OF, THE TOWN OF LOUIS- <br /> VILLE, COLORADO: <br /> Section 1. --A Police Department is hereby established, the officers <br /> of which shall consist of one Town Marshal who shall be known as <br /> the Day Marshal and Water Commissioner ex-officio, and one Deputy <br /> Marshal who shall be known as the Night Marshal and as many Spec- <br /> ial Officers or Police as may from time to time be appointed. Pro- <br /> vided, that such designation as Day and Night ,Marshal shall not be <br /> construed to limit either of them in the performance of his duty <br /> during any hour of the day or night time. <br /> Section 2. The Day Marshal shall be the chief police officer in <br /> the Town during such portion of the time as he may be on duty, and <br /> the ' Deputy or Night Marshal shall perform the duties of the Day <br /> Marshal, exclusive of his duties as Water Commissioner, during the <br /> night time Qr during such time as the Day Marshal is off duty, <br /> and shall, together with all Special Officers or Special Police, <br /> be subject to the direction and instructions of the Day Marshal. <br /> PROVIDED, - That the Mayor shall have supervision and control of the <br /> Marshals and Special Officers or Police and instruct and direct <br /> them from time to time as to the performance of' their duties as <br /> in his judgement the welfare of the Town may require. <br /> Section 3. The Marshals and any Special Officers or Police that <br /> may be appointed, shall serve the particular hours of the day or <br /> , night that, shall, from time to time be fixed by resolution of the <br /> Board and while on duty shall be on the alert to prevent the com- <br /> mission of crime as well as to enforce the ordinances of the Town. <br /> While on duty they shall wear on their left breast a metalic badge <br /> designating their particular office. <br /> Section 4.. They shall have authority and it shall be their duty <br /> to quell riots, dispel mobs or unlawful assemblies, make arrests, <br /> with or without warrant as the laws or ordinances may permit or re- <br /> quire , and when necessary to make arrests they may enter into any <br /> house, building, room, car or other enclosure, with force, if nec- <br /> essary. They shall see that all persons liable thereto, shall take <br /> out a Town license as may be provided by ordinance , and one of the - <br /> said Marshals or Police shall be present to preserve order at all <br /> assemblies held by virtue of any license or permit issued by the <br /> Town. <br /> 111 Section 5. " It shall be the duty of the Marshals or Special Officers <br /> when an 'arrest is made, to forthwith take the person arrested before <br /> the Police Magistrate or proper Justice of the Peace and make com- <br /> plaint, if complaint has not been made , and the accused shall have <br /> a "sppedy trial, PROVIDED, that a reasonable time may be take by the <br />
