Of People, or granted to the accused -to prepare for -trial, and <br /> PROVIDED, that persons arrested in the night time or -upon the first <br /> day of the week, commonly called Sunday, may be detained-in, the <br /> Town jail until the next day 9r Monday following, and until they <br /> are tried and discharged by law, and 'ROVIDED, further, -that when <br /> a case is continued the accused may give a bond or undertaking with <br /> security to be approved by the Magistrate or Justice of the Peace <br /> before whom such trial is pending for his appearance at the time to <br /> which such case is continued. <br /> Section 6. Any Marshal or Specit,. Officer or Police who shall fail or <br /> neglect to discharge his duty oxjeonnive at a violation of an ordin- <br /> ance or become inefficient shall be subject- to removal by resolution <br /> of the Board, and any vacancy occurring in any manner may filled <br /> in the same manner as provided for the filling of said office in' <br /> the first instance. <br /> Section 7,.. Amended by Ordinance No, 99. <br /> Section 8. The Mayor may appoint Special Officers ,or Police when, <br /> in his judgement, it is necessary for the preservation of the peace <br /> and good order of the town, which appointment or appointments when <br /> made for a period exceeding thirty (30) days, shall be confirmed <br /> and ratified by the Board and each of such appointees upon his 'ap- <br /> pointment by the Mayor shall receive from him a written commission <br /> of his authority, signed by the Mayor and attested by the Clerk of <br /> the Town, with the seal of the Town affixed, and shall be revocable <br /> by the Mayor at any time, and who, when appointed, shall take the <br /> usual oath and be subject to the instructions of the Mayor and Mar- <br /> shal while on duty. Any of such Special Officers or Police shall <br /> receive such compensation as may be fixed by the Board, but nothing <br /> in this ordinance contained shall be construed as requiring an oath <br /> of office from persons specially deputized to assist any officer <br /> as provided in section four of this ordinance. <br /> "/` Section 9. Any person or persons who shall resist any Marshal or <br /> other Police Officer in the discharge of his duties or shall in any <br /> way interfere with or hinder or prevent him from discharging his <br /> duty, or shall offer or endeavor so to do, or in any manner assist <br /> any person in the custody of any such officers to escape, or iii an <br /> attempt to escape from such custody, or attempt to rescue any per- <br /> son or persons so in custody shall on conviction thereof be fined <br /> not to exceed Three Hundred ($300,00) Dollars. <br /> ,Section 10. It shall be the duty of all persons in the Town, when <br /> called upon by any Marshal or Special Officer or Special ,Police to <br /> promptly aid or assist him or them in making arrests, quelling dis- <br /> turbance, giving pursuit to or in apprehending any violator of the <br /> ordinances or ,the law, or in the discharge of his or their duties <br /> requiring immediate and prompt action. Whoever shall refuse to <br /> give 'such aid or assistance, shall be fined, on conviction thereof, <br /> not to exceed Three Hundred ($3Q0.00) Dollars. <br />
