Section 5. That initiative and referendum. petitions shall consist <br /> II Of sheets, having , such general form printed or written""'at-the: top <br /> thereof' as -shall- be' designated-or- preseribed� by l&Wn' or,"iii the ab- <br /> seiic'e Of such` statutory"provisi.bii, vby the"To?n?ii Clerk; eU h 'petitions <br /> shali'be . signed -by' q ialified-electors 'in:' their proper' person only. <br /> To 'such' signature " shall' be attached` the' residence address of such <br /> person and the date of signing the same. , To each of such petitions <br /> which May- consist of one or "more sheets, shall be -attached an affi- <br /> davit Of some qualified elector" that each signature thereon is the <br /> signature of the person whose name it purports to be, and that to <br /> the best of the knowledge and belief of the affiant, each of the <br /> persons signing said petition was at the time of signing a qualified <br /> . elector, The style of all ordinances adopted by the people of the <br /> Town of Louisville, through the initiative , shall be ; " BE. IT <br /> ORDAINED BY THE PEOPLE OF THE TON OF 'LuUISVILTE. " All proposed <br /> initiative and •referendum measures shall become law or ,ordinances <br /> in the Town of- Louisville, Colorado., when approved by a majority <br /> of the votes cast thereon and not, otherwise; and shall take effect <br /> from and after the date of the offical canvass of the vote thereon <br /> and the publication thereof for the time required by law for the <br /> publication of ordinances in incorporated towns. The canvass of <br /> the vote on measures referred or submitted to the people of the <br /> Town of Louisville shall be made by the Town Clerk in the manner <br /> prescribed by law for canvassing the vote cast for municipal of- <br /> ficers in incorporated towns.' The veto power of the Mayor shall <br /> IIInot extend to measures initiated by or referred to the people. <br /> Section 6. All petitions . when so signed and sworn to shall be deemed <br /> and held to be sufficient. If they appear to be signed by the re- <br /> quisite number of signers, and all such signers shall be deemed <br /> and held to be qualified electors, unless a protest in writing, <br /> under oath shall be filed with the Town Clerk within Ten (10) days <br /> after such petition is filed setting forth the name of each signer <br /> protested against and the ground or grounds of such protest. The <br /> Town Clerk shall fix a time not less than Twenty four ( 24) hours <br /> nor more than Five ( 5) days after the filing of said protest for <br /> hearing evidence in support of the same, at such hearing which shall <br /> be held by said Town Clerk all evidence shall be under oath,which <br /> oath may be administered by the Town Clerk and any signer present <br /> at the hearing may be called as a witness by the protestant Or <br /> may testify in his own behalf. All signers protested against shall <br /> be notified by the Town Clerk in writing of the time and place of <br /> such hearing which notice may be given by mailing a copy thereof <br /> of such signer or signers in a properly addressed envelope or en- <br /> velopes and with the proper postage prepaid thereon, at least three <br /> ( 3) days before the date of such hearing. Such notice or notices <br /> to be deposited in the Post Office in said Town of Louisville. <br /> Akl hearings shall be summary and not subject to delay, and shall <br /> be concluded within Ten ( 10) days after such testimony is taken. <br /> IIIIn case the petition is held sufficient it shall be filed as Of <br /> the date of its original presentation and if held insufficient in <br /> form it may be corrected as to insufficienty inform by a majority <br /> irvuumber of the persons named. therein as representing the signers <br /> and if no person or persons .are named as representing the signers <br /> then by a majority of the signers. <br />
