Section 10. ANY PERSON MAY TAKE UP ANIMAL AND DELIVER TO TOWN MARSHAL. - <br /> It shall be lawful for any person to distrain and take up any animal <br /> found running at large contrary to the provisions of this chapter, and <br /> to deliver the same to the Town Marshal or any other Town Officer who <br /> shall receive such animal and proceed in like manner as if he had been <br /> taken up by him or his authority. <br /> Section 11. COSTS TO BE FIXED AND TAXED--PAID INTO THE TREASURY -EX- <br /> PENSES. PAID FOR SALE. <br /> The costs and the expenses mentioned in- this Ordinance shall be taxed <br /> as follows ; The actual costs of advertising by posting notices , and <br /> also costs of taking and impounding such animals and keeping and feed- <br /> ing the same, which last mentioned charge shall not exceed One Dollar <br /> ( 1. 00) per day or fraction thereof. All the fees above mentioned <br /> shall be collected by the Town Marshal and turned over to the Town <br /> Treasurer. 211 expenditures incurred shall be paid as other claims <br /> against the Town and all moneys collected paid to the credit of the <br /> Town with the Town' s general fund. /'' <br /> Section 12. PENALTY CLAUSE. <br /> Any person who shall violate any of the provisions of this chapter, <br /> shall upon conviction thereof be fined in the sum of not less than <br /> Two Hundred Dollars ($200. 00) for each and every offense. <br /> Section 13. REPEALING CLAUSES. <br /> All ordinances and parts of ordinances in conflict herewith are here- <br /> by repealed. <br /> Section 14. EMERGENCY CLAUSE. <br /> It is hereby declared that this ordinance and the provisions thereof <br /> is necessary for the immediate preservation of the public health, <br /> peace and safety. - <br /> Introduced, read, and adopted, and ordered published, this 3rd day <br /> of August , A.
