times to the examination of any elector of the Town, and he shall <br /> make a written report to the Board of Trustees of the Town at its <br /> last regular meeting of each fiscal year, and at such other times <br /> as the Town Board of Trustees may require, of the acts and doings <br /> of the Pension Board. <br /> SECTION 3. The Town Treasurer, and ex-officio Pension Board <br /> Treasurer, shall make and keep, separate from his accounts as Town <br /> Treasurer, an account of the funds in and coming into the Pension <br /> Board funds, and disbursements therefrom as may be ordered by the <br /> Pension Board, and of all investments of such funds as may be order- <br /> ed by the Pension Board, and he shall keep such funds distinct and <br /> separate from all, other funds in his custody as Town Treasurer and <br /> shall deposit such funds in such bank or invest in such legal <br /> securities as the Pension Board may direct. He shall make a report <br /> to. the Board of Trustees of the Town of the amount_ and condition of <br /> such funds as it may from time to time direct , and in all reports as <br /> Town Treasurer shall include such funds and/or investments thereof <br /> in his monthly report to the Town of the regular town moneys, and <br /> shall identify same by some appropriate designation. His bond as <br /> Town Treasurer shall extend to and cover such Pension Funds. <br /> SECTION 4. In the event that the Town Marshal shall suffer <br /> an injury or be incapacitated while performing police duties for <br /> the -Town, or be killed while performing such duties, then, in the <br /> former event, he may file a written application to the Pension <br /> Board for relief by way of payment to him from the said Fund for <br /> his injury, or injuries, or incapacitation, as the case may be , and <br /> therein setting forth the particulars of the time , place and cause <br /> of his injury or injuries and of his incapacitation, if any; and in <br /> case he should be killed while so performing his duties, then such <br /> application shall be made and filed by his dependent or dependents <br /> and in case of a dependency claim same shall be supported by proof <br /> in like manner as is required under the Workmen' s Compensation Law <br /> of Colorado in dependency claims. Upon the making and filing of <br /> such an application the Pension Board shall meet as promptly as is <br /> reasonable under the circumstances and proceed to consider, pass <br /> upon and determine the facts and of the liability of such Fund for <br /> relief, and the amount in gross, or installments, which should be <br /> allowed and ordered paid therefrom if such liability is establish- <br /> ed to the satisfaction of the Board. Provided, that if, during <br /> the curing of any such injury or during the pendency of such in- <br /> capacitation, the Marshal shall continue receiving his regular <br /> salary from the Town as Marshal, then the Pension Board shall only <br /> allow to him for medical, surgical and hospital costs and care. <br /> Provided, further, that allowances from such Fund for injury, in- <br /> capacitation or death of any Marshal, including any medical, <br /> surgical and/or hospital cost and care, shall never exceed, in <br /> total, the sum of One Thousand Dollars.
