B. Disturbance at Gentleman Jim's Bar & Grill <br /> <br />A disturbance occurred at Gentleman Jim Bar & Grill which involved police intervention. An incident, <br />occurring July 19, 1998, allegedly involved the serving an intoxicated person and later resulted in a <br />domestic disturbance. After considerable discussion, it was the consensus of the Authority that probable <br />cause exists with respect to a violation of serving a visibly intoxicated person, and that this matter should <br />be set for a show cause hearing on Monday, November 30, 1998. <br /> <br />C. Incident at American Legion <br /> <br />A police investigation of a suicide alleged that there may have been a violation of the liquor code at the <br />American Legion on August 8, 1998. The police report alleged the serving of an intoxicated person. <br />Kimmett excused himself from the discussion. Sergeant Riggins reported that the reports have not been <br />completed or finalized. This matter was tabled and will be reviewed at the next meeting when completed <br />reports may be available. The Authority requested that the American Legion file be researched for <br />evidence of employee liquor training in the past calendar year. <br /> <br />SECRETARY'S REPORT <br /> <br />The Secretary reported that World of Wonder, Ltd., d/b/a WOW! Children's Museum - 1075 South <br />Boulder Road, Suite 130, had applied for a Special Events Permit for the following dates - September 11, <br />1998, October 23, 1998, November 13, 1998, and December 11, 1998. The times of each event are from <br />4:00 p.m. - 9:00 p.m. Notice of the application for a special events permit was posted at the <br />establishment from July 29 though August 7, 1998. No written objections were received, the application <br />was approved the Authority Secretary on August 11, 1998. <br /> <br />AUTHORITY ATTORNEY'S REPORT <br /> <br />Attorney Light noted that the Authority packet included a copy of a draft Stipulation and Agreement for <br />Pine Street Junction. Due to conflicts of interest, local attorneys could not represent the Authority in the <br />Show Cause Heating scheduled for Monday, September 21, 1998. Light had notified Chairperson Jeff.ers <br />relative to resolution of the matter prior to the actual hearing date. The Authority Secretary was asked to <br />contact the owner of Pine Street Junction and ascertain whether they would be agreeable with such a <br />resolution. It was determined that owner was interested in resolving the matter through Stipulation and <br />Agreement. The consensus of the Authority was to authorize staff.to finalize a proposed Stipulation and <br />Agreement, to resolve the matter in lieu of a show cause heating. Attorney Light will contact the owner <br />relative to finalizing the paperwork, which will be presented to the Authority on its next meeting, <br />September 21, 1998. <br /> <br />Light also noted that at the last meeting, finger print records check of the manager of the Outback <br />Steakhouse reflected a charge of DWAI and FTA. One of the stipulations for granting the transfer <br />license of the Outback Steakhouse was that the manager record be reared. The Authority packet <br />included a certified copy from the Adams County Court, showing all charges in question were dismissed. <br /> <br />5 <br /> <br /> <br />
