C6,i That the variance, ifgranted, is the minimum variance that will afford relief and is the least <br /> modification possible of the provisions of Title 17 of the Louisville Municipal Code that is in <br /> question. <br /> The applicant is proposing a 4:12 roof pitch,which was the standard in the Old Town Overlay <br /> District prior to a recent modification(when the 6:12 was established)—Ord. No. 1519-2007, <br /> 6/5/07). The 4:12 roof pitch is the minimum roof pitch requested by the applicant and is the <br /> minimum roof pitch required for the proposed design.KStaff.finds-tlus=cr-iterion-has-been met <br /> PUBLIC COMMENTS: <br /> Public notice was mailed to all property owners within 500 feet of the subject property. We have <br /> not received any public comments on the variance application. <br /> STAFF COMMENTS/RECOMMENDATION: <br /> [.,,, <br /> Staff acknowledges that this request is to reduce the overall size of the structure,which the applicant <br /> believes is oversized for the lot. The applicant has chosen to reduce the overall size of the structure <br /> and to propose a design that would increase the overall appearance of the property. The proposed <br /> design also allows for the structure to be over 6' less than the permitted 27' maximum building <br /> height on the property. <br /> \-- s the request does not meet all the applicable"Variance Review Criteria"staff is recommending <br /> disapproval of the variance. The minimum roof pitch requirement in the Old Town Overlay Zoning <br /> is'}intended to preserve the historic character of Old Town Louisville. Staff acknowledges that while <br /> thi proposed building plans do not comply with the minimum roof pitch,there is clear intent on the <br /> part of the applicant to redevelop in a manner consistent with a specific architectural theme. It <br /> should be noted if this request is approved, the variance does not approve the proposed site plan of <br /> the proposed structure. The applicant will be required to comply with the lot area and FAR <br /> established in the Old Town Overlay District and would be required to apply for a Building Permit <br /> prior to proceeding with construction. <br /> z <br /> BOARD ACTION: <br /> The Board may approve(with or without condition or modification), deny or continue the <br /> application to a future meeting for additional consideration. The Board may also request additional <br /> information if they feel that is needed for their proper consideration of the variance application. The <br /> Board needs to find that all six variance criteria, insofar as applicable,have been met in order to <br /> grant approval of a variance. The variances, if granted would be valid for six (6)months.
