Zoning Variance Request
Creel E. Kerss
ECEIIVE
111 PEAR 17 2008 -1/
Criteria
PLANNING
1. That there are unique physical characteristics or conditions such
as irregularity, narrowness or shallowness of let, or exception
topographical or other physical conditions peculiar to the affected
property.
The current lot size at 105 Roosevelt (100'w X 150'deep — 15,000 sq. ft.) is too
large to fit the intent of the Old Town overlay Zoning District (OTO). Existing
lot size would allow a large home of 5300 +,21+ basement, less garages, which
would be out of character with the neighborhood and the OTO.
By Re-platting this lot to 2 smaller lots, 58' x 150' deep (with existing residence)
and a second of 42' x 150', it would allow construction of 2 more modest size
homes, more in keeping with the neighborhood.
2. That the unusual circumstances or conditions do not exist
throughout the neighborhood or district in which the property is
located
To build to the full capacity of this oversized lot would require a large home
which would be out of character with the neighborhood and OTO.
3. That because of such physical circumstances or conditions, the
property cannot be reasonable developed in conformity with the
provisions of this title (Louisville Zoning Code):
The current new residence size in the OTO is usually less than 3000 sq. ft. This
cannot be done on the current oversized lot to utilize the lots full capacity. The
lots created would still be of ample size—6300 sq. ft. and 8700 sq. ft. and be more
in keeping with the OTO.
4. That such unnecessary hardship has not been created by the
applicant:
The hardship is created by the large size of the lot. The waste of natural resources
to maintain this parcel creates a hardship. By re-platting the lot to more normal
sizes, with 2 modest homes and smaller yards is a better use of the property.
