VI. AUTHORITY BUSINESS <br /> <br />Show cause Hearing - Hei Han Enterprises, Inc., d/b/a Henry's Bar & Grill - Tavern <br />License - 935 Pine Street. <br /> <br />Special Prosecutor Steve Barnett was present to review the proposed Stipulation and Agreement for <br />Henry's Bar & Grill. Barnett conducted an investigation on the incident in question and had discussions <br />with the licensee. He informed the Authority that the licensee is not inclined to contest the matter and is <br />agreeable to a seven (7) day suspension. As proposed, the suspension which would begin at 12:01 a.m., <br />November 25, 1998 and end at midnight December 1, 1998. Provision ~4, of the Stipulation and <br />Agreement requires training of any employee handling alcohol. <br /> <br />Attorney Light noted that this the third show cause order for Henry's Bar & Grill in the last two years, <br />and that the Authority Rules do not include penalty guidelines for a third offense. Henry's has gone more <br />than one year since its last violation. Light stated that a seven-day suspension is not required or <br />prohibited by the Statutes or Authority Rules. The Authority should consider if it is appropriate given the <br />mitigating or aggravating circumstances of the incident. <br /> <br />Discussion/Direction - Gentleman Jan's Inc., d/b/a Gentleman Jan's Bar & Grill Show <br />Cause Hearing Matter. <br /> <br />Special Prosecutor Steve Barnett stated that he had completed an investigation on the incident which <br />resulted in the Show Cause Hearing for Gentleman Jan's Bar & Grill. He stated that the investigating <br />police officer had determined there was no probable cause for citation for a liquor code violations and <br />that the evidence did not support moving forward with a hearing in fi'ont of the Authority. Barnett stated <br />that he preferred not to go forward with the hearing proceedings and asked the Authority for a motion of <br />dismissal. <br /> <br />3 <br /> <br /> <br />
