Local Licensing Authority <br />Minutes <br />January 28, 2008 <br />Page 4 of 5 <br />D. Incident Report - 3 Margaritas - 12/24/07 <br />Intoxicated parties were reported in a parking lot next door to this establishment. <br />Discussion centered on whether or not the Authority could find any reason to <br />order a show cause. The Authority decided no further action could be taken. <br />E. Incident Report -The Back Room - 1/3/08 <br />This incident involved the police being dispatched to assist medical personnel <br />with a person who had passed out. <br />Wilson moved the Authority issue an Order to Show Cause and Notice of <br />Hearing to The Back Room for serving to a visibly intoxicated person. <br />Rommelfanger made a friendly amendment to set the hearing for March 24, 2008 <br />and appoint a special prosecutor. Wilson accepted the amendment to the <br />motion. Lipton seconded. Roll Call Vote: Wilson -yes, Lipton -yes, Carlson - <br />yes, Mulvahill -yes and Rommelfanger -yes. <br />Secretary's Report <br />Hanson reported on the dates for Authority meetings in 2008 including the Study <br />Session in May with City Council. <br />Secretary Hanson stated there were nine attendees at the December 2007 <br />seller/server training and thanked the Police Department for providing the <br />training. <br />Hanson commented the Empire Restaurant and Lounge had met the conditions <br />of their transfer approval from the last meeting and received their liquor license. <br />According to the Charter amendment, each Board and Commission member is to <br />receive a copy of the Open Government and Ethics Pamphlet at the first meeting <br />of each year. Hanson pointed out to members of the Authority she had provided <br />a pamphlet for each of them. <br />Authority Attorney's Report <br />Delaney Lew reported she would not be at the March meeting, however, she <br />would prepare the show cause hearing materials and arrange for the special <br />prosecutor and someone from her office would cover that meeting. <br />Authority Comment <br />Comments were made about the legislation concerning Sunday liquor sales and <br />liquor sales in large box retailers. Both issues could result in big changes for the <br />state as a whole if they are approved. The Authority will continue to follow these <br />issues. <br />
