Local Licensing Authority Minutes January 28, 2008 Page 4 of 5 D. Incident Report - 3 Margaritas - 12/24/07 Intoxicated parties were reported in a parking lot next door to this establishment. Discussion centered on whether or not the Authority could find any reason to order a show cause. The Authority decided no further action could be taken. E. Incident Report -The Back Room - 1/3/08 This incident involved the police being dispatched to assist medical personnel with a person who had passed out. Wilson moved the Authority issue an Order to Show Cause and Notice of Hearing to The Back Room for serving to a visibly intoxicated person. Rommelfanger made a friendly amendment to set the hearing for March 24, 2008 and appoint a special prosecutor. Wilson accepted the amendment to the motion. Lipton seconded. Roll Call Vote: Wilson -yes, Lipton -yes, Carlson - yes, Mulvahill -yes and Rommelfanger -yes. Secretary's Report Hanson reported on the dates for Authority meetings in 2008 including the Study Session in May with City Council. Secretary Hanson stated there were nine attendees at the December 2007 seller/server training and thanked the Police Department for providing the training. Hanson commented the Empire Restaurant and Lounge had met the conditions of their transfer approval from the last meeting and received their liquor license. According to the Charter amendment, each Board and Commission member is to receive a copy of the Open Government and Ethics Pamphlet at the first meeting of each year. Hanson pointed out to members of the Authority she had provided a pamphlet for each of them. Authority Attorney's Report Delaney Lew reported she would not be at the March meeting, however, she would prepare the show cause hearing materials and arrange for the special prosecutor and someone from her office would cover that meeting. Authority Comment Comments were made about the legislation concerning Sunday liquor sales and liquor sales in large box retailers. Both issues could result in big changes for the state as a whole if they are approved. The Authority will continue to follow these issues.
