Local Licensing Authority <br />Minutes <br />March 24, 2008 <br />Page 3 of 8 <br />He spoke with Ginny Newman, owner of the bar, and she had not observed the <br />scuffle in the bar. <br />Sergeant Mike Abromowich of the Louisville Police Department was sworn in and <br />testified he was in charge of the team responding to the fight in the parking lot on <br />the night in question. He interviewed Brian Sorette, who was involved in the <br />incident in the parking lot. Sorette reported his friend, Clinton Bingaman, <br />accidentally bumped into Pablo Lujan in the bar, and things began to get <br />"heated" so he and his friends decided to leave. Lujan and his friend followed <br />them out. Sergeant Abromowich interviewed Pablo Lujan who stated Clinton <br />Bingaman bumped into him and they exchanged words, the bartender came <br />over, broke them up, and took the pool cue from Lujan. Lujan reported words <br />were exchanged as the other parties left the bar and he left shortly afterward. <br />During his interview with Patrick O'Neal, Sergeant Abromowich reported O'Neal, <br />who was also involved, felt if Pablo Lujan had been removed after the first <br />incident, the fight outside would not have occurred. <br />Officer Patrick Fitzgibbons was sworn in and testified. He issued a summons to <br />the bartender, Jennifer Zane, for not reporting the disturbance inside the bar. <br />Zane felt if she had not intervened in the bar it could have escalated into an <br />incident. Officer Fitzgibbons was asked by Mr. Newman if Ms. Zane indicated <br />how much time elapsed between the incident in the bar, parties leaving the bar <br />and the fight outside. His impression was it all occurred within a couple of <br />minutes. <br />Patrick Ryan O'Neal, 305 W. Hawthorn Ct., Louisville, CO was sworn in and <br />testified he was at the Back Room with his girlfriend and his friend, Clinton <br />Bingaman and Bingaman's girlfriend. He was the designated driver for the <br />evening and didn't drink that night. He said he received a summons for <br />disturbing the peace for his part in the incident in the parking lot. He testified <br />someone told him Bingaman was getting in a fight in the bar and he separated <br />Bingaman and Pablo Lujan. He stated Lujan taunted and threatened him and his <br />friends. O'Neal asked his friends to leave and when they left Lujan and Scott <br />Watson followed them out and attacked them. Mr. Newman asked if O'Neal or <br />anyone in his party did any taunting or provoking and O'Neal responded no. Mr. <br />Newman showed the video of the incident and asked if Mr. O'Neal felt <br />threatened, why it took so long for them to actually leave. <br />Mr. Newman called Jennifer Zane, who was sworn in and testified. She was <br />tending bar at the Back Room on November 19th. She was busy working, heard <br />her name called, grabbed the phone, walked around the bar where two guys <br />were having a disagreement. She separated them, they apologized and one <br />asked if his girlfriend could finish her pizza, Zane agreed. Everything then <br />seemed okay. She did not see any physical interaction that night and saw no <br />reason to call the police. She heard no further comments from either group after <br />the apologies.. <br />Zane became aware of the fight in the parking lot when a patron told her. She <br />grabbed the phone and called the police after she got outside. <br />Virginia Newman, owner of the bar was sworn in as a witness and testified. She <br />was in the kitchen most of the evening. She was closing out the register when <br />
